As we enter hurricane season, concerns about property damage from overhanging trees are on the rise. Living in Florida, this is a constant threat. To ensure we all live harmoniously with our neighbors, I wanted to share a friendly reminder about the laws regarding tree removal and safety. During a hurricane, it can be challenging to determine whose tree caused the property damage, and making assumptions is not advisable. Instead of pointing fingers, it's important to remember that we have insurance to protect our property from damage. So, who is responsible for cutting overhanging tree branches? Is it my neighbor's responsibility? According to Florida law, landowners are not liable for nuisances caused by vegetation growing from their land onto adjoining properties (Scott v. McCarty, Fla. 4th DCA 2010). This means your neighbor is not obligated to remove or trim branches or roots that extend past your property line. However, you do have options. You are allowed to trim any tree, root, branch, or other vegetation that grows over your land, but it must be done at your expense (Gallo v. Heller, Fla. 3rd DCA 1987). https://lnkd.in/ev8TYX63

Here’s how to do it: 1️⃣ Place sandbags in areas where water could seep in, like doorways, garages, and lower-level windows. 2️⃣ Layer them tightly, overlapping like bricks for maximum defense. 3️⃣ Ensure bags are filled halfway with sand to allow for better stacking and coverage. As Hurricane Milton closes in, we're now in a waiting game to see where it will make landfall. We're hoping for further weakening, but it's unlikely we'll escape without significant damage. Everyone who chose to evacuate has already done so, and communities have come together, with people opening their homes, sharing resources, and volunteering their time selflessly. Despite dealing with their own recovery efforts from the last storm, neighboring states are stepping up—stationing line crews, sending supplies, and managing traffic flow out of Florida. Each time we prepare for these storms, it’s a moment to reflect on our state's readiness. A special thanks goes out to all the state personnel working tirelessly to ensure we're as prepared as possible. Our National Guardsmen are in position and ready, the highway patrol is escorting fuel trucks, and we've got Starlink backhauls set up across the state. Cellular providers have rolled in COWs (cell on wheels), and Floridians are showing their resilience—staying calm, helping each other out, and securing their homes. Companies with a presence in Florida, like Wells Fargo, Walmart, and Publix Super Markets, are pitching in as well—even furniture stores are opening their doors to shelter people! Restaurants and hotels are keeping prices low to accommodate as many people (and their pets ❤️) as possible. I’m incredibly proud to live in this state and deeply grateful for the steady leadership of Governor Ron DeSantis—his calm presence is truly remarkable. Whatever comes our way, we’re as ready as we can be. Florida proud!
