There have been many posts about the Department of Labor raising the salary threshold for employees who are exempt from the overtime pay requirements as of July 1. Don't forget that raising the salary of an employee who doesn't perform exempt duties isn't sufficient to make that employee exempt. And don't forget that some states (like NY) have a higher salary threshold than even the new federal amount. Yes, if salaried employees are classified as non-exempt, they are still entitled to overtime. Their pay rate must be calculated based on their weekly salary and hours worked. #EmploymentLawyer #NYCLawyer #LegalRepresentation #LegalAdvice #EmploymentDiscrimination #newyork
