🚨 Important Update on Massachusetts Employment Law 🚨 A recent federal court ruling clarified that employers in Massachusetts cannot inquire about an arrest that did not result in a conviction, even if the prospective employee voluntarily discloses the arrest during the hiring process. In Meuse v. National P.I. Services, LLC, a prospective firefighter disclosed a dismissed domestic assault charge on his job application. Although the applicant voluntarily provided this information, the employer's background check agency asked him for more details during an interview. The court found that asking about the arrest directly violated Massachusetts non-discrimination laws (Chapter 151B), which strictly prohibit inquiries into arrests that did not lead to convictions. 𝗞𝗲𝘆 𝗧𝗮𝗸𝗲𝗮𝘄𝗮𝘆𝘀 𝗳𝗼𝗿 𝗘𝗺𝗽𝗹𝗼𝘆𝗲𝗿𝘀: - Even if an employee or applicant mentions an arrest voluntarily, do not ask for further details. - Violating Chapter 151B by asking about arrests without convictions can lead to legal consequences. - Employers can gather information from external sources but must tread carefully when it comes to discussing arrests directly with the individual.
