Again, we journey to this day of the year... I remember that sunny day, when I walked across town from my home on the Eastside to my office on the Westside. I was engrossed in my Italian vocabulary cards, and only when I was crossing Fifth Avenue did I look up and noticed the columns of smoke rising from the Downtown area into the clear blue skies. Then there was gathering in the conference room, tracking down colleagues who were in the field, the ground shaking as the towers collapsed, and the numb crowds that wondered the streets... What was even more meaningful was watching the people come together afterwards. I found my "DNA Volunteer" badge: it was handwritten! This was issued in the temporary space where NYPD had set up to collect DNA samples from families with missing loved ones. The operation was set up so quickly there was no time to print proper badges. I connected the NYPD operation with my Microsoft colleagues, who immediately stepped up with much-needed expertise, software, and hardware for tracking records. Our volunteer work continued for months, including getting "real" ID badges for Red Cross volunteers. I became friends with some of the families I met and accompanied them to the memorial service at Ground Zero. Crisis doesn't define us. How we respond - as a community - has defined us. For those who are interested in a peek at what #corruption looks like in the U.S., the trial of Senator Menendez would be a good place to start. Today, he was convicted by a federal jury on 16 counts, including bribery, fraud, acting as a foreign agent, and obstruction. As someone who grew up in New Jersey, I'd say this has been a long time coming. You might wonder why this case was brought by the federal prosecutors in Manhattan? Something you might consider is the fact that the senior senator of the state of the party in power is the usually the one who nominates the United States Attorney (top federal prosecutor) and federal judges in the state. Two months ago, I posted about the facts and #SCOTUS arguments in Snyder vs. United States. Yesterday, the Supreme Court made a decision. Quick recap: Government Official ("GO") appointed his friend ("Buddy") to run the public bidding process to buy trucks for the government. Buddy "tailored the bid specification to favor" Company. Company won the bid. Company also had another truck that it had not been able to sell for two years. Buddy again "adjusted th[e] specifications" to match Company's truck. Company again won the bid. Three weeks after the second bid, Company issues a $13,000 check to a firm owned by GO. The issue before the court was: was it a federal crime (under 18 U.S.C. §666) for state and local officials to accept gratuities such as this payment "as a token of appreciation after the official act"? Justice Kavanaugh, writing the the majority said: "The answer is no." The court's full opinions, particularly the dissent by Justice Jackson, is worth reading: https://lnkd.in/g8wKzy4d Lindsay Whitehurst of The Associated Press noted that this decision "continues a pattern in recent years of the court restricting the government’s ability to use broad federal laws to prosecute public corruption cases." My questions to the #anticorruption #ethics #compliance #FCPA community are: 1. How does this decision impact your training and messaging, particularly to audiences outside of the United States? 2. How does this decision impact how you distinguish what is "legal" vs. what is "ethical"? 3. Do you ever wonder why so little of #FCPA discussions are based on actual - litigated - law and legal analysis? This case reached SCOTUS through a litigation process: jury trial, conviction, appeal. There was no happy dance over a declination or a resolution. Lots to think about...would love to hear your thoughts.
Does this sound like an anti-bribery training scenario? Government Official ("GO") appoints his friend ("Buddy") to run the public bidding process to buy trucks for the government, even though Buddy has no prior experience in administering public bidding. Buddy "tailored the bid specification to favor" Company. Buddy also directed bids to be submitted to the GO rather than to the government treasurer as was customary. Company won the bid. GO then tried to get government to buy another truck that Company has not been able to sell for two years. Buddy again "adjusted th[e] specifications" to match Company's truck. Company again won the bid. Three weeks after the second bid, Company issues a $13,000 check to a firm owned by GO. This was, however, no training hypothetical. These are facts from a case argued before the United States Supreme Court this past Monday. This is also no foreign corruption: it was a domestic criminal prosecution under 18 U.S.D. §666. The issue before the court was: was it a federal crime (under §666) for GO to accept payment "in recognition of actions the official has already taken or committed to take," without evidence of a prior quid pro quo agreement? The oral argument was very lively. Here is my favorite exchange: Justice Sotomayor to GO's lawyer: "...you are suggesting that the federal government can't say there is something wrong with demanding payment after the fact for an official act." GO's lawyer: "Absolutely." Court observers seem to believe that #SCOTUS is inclined to rule in favor of GO. What say you? #bribery #corruption #FCPA #ethics #compliance
