What the Arizona Supreme Court's Mayes Decision Reveals About the Future of Abortion Law || Excerpts from Experts Recently, the Arizona Supreme Court's ruling in Planned Parenthood Arizona v. Mayes (2024) addressed the conflict between a historical 1864 abortion statute (ARS § 13-3603) and a more recent law permitting abortion up to fifteen weeks (ARS § 36-2322). While the case did not directly question the constitutionality of these laws, the divided decision underscores challenges in applying the older statute following the U.S. Supreme Court's Dobbs v. Jackson Women's Health Organization (2022) decision. End of a hectic week, where the Engender Scotland team launched our analysis of Scotland’s increasing antiquated abortion laws. We detail how Scotland and the UK is failing to keep pace with international standards at European and UN level on reproductive rights. We also demonstrate how Scotland’s legal framework is now increasingly at odds with clinical best practice and medical advances. This is placing women and clinicians at risk of unjust scrutiny and potential criminalisation. It’s also holding back development of the highest possible standards of care. We couldn’t have foreseen that our launch date would coincide with the announcement of a UK general election. In many ways the timing is apt as it allows us to send a clear message to candidates that: 🟣 It’s time for action on abortion law 🟣 The next Government must show leadership if it’s to safeguard abortion rights for future generations of Scotland’s women 🟣There is broad public and clinical support for abortion rights in Scotland.

Today marks the second anniversary of the Dobbs decision overturning Roe v. Wade, which had protected the constitutional right to abortion in the U.S. for almost 50 years. Since June 24, 2022, 14 states have banned abortion across the United States, largely concentrated in the South. An additional 6 states have early gestational limits between 6 and 15 weeks LMP (last menstrual period).
