Generally speaking, a Motion for Continuance is extremely limited in an eviction lawsuit and usually requires agreement by both sides. The courts try to crank these cases out at a relatively high speed compared to most other civil claims. While the average Justice Court Civil claim may go for 6 to 9 months, and eviction is usually wrapped up in 30 to 45 days. However, a Motion for Continuance may be granted in the event of an emergency. #TexasPropertyCode #TexasLandlords #Landlords #Landlording #LandlordAttorney #TexasPropertyRights #PropertyLaw #Court #Trial #MotionForContinuance #RentalProperty #ErnieGarcia #JP #Lawsuit #JusticeofthePeace #ServiceofProcess #Jurisdiction #CountyCourt

The New York Court of Appeals, the state's highest court, plays a significant role in shaping the legal landscape of New York. I am currently reviewing the case of Mahautiere v. New York City Transit Authority, which involves a claim of "failure to provide adequate air conditioning on a subway line operated by the defendant on which the plaintiff was a passenger." This case highlights the potential for national influence on state law, as decisions by the New York Court of Appeals can serve as precedent for courts in other jurisdictions. https://lnkd.in/e2SZpes5 #NYSCLeadership #NYSupremeCourt #JudicialLeadership #NYCourts #AccessToJustice #JusticeForAll #CourthouseReform #NYLaw #LegalSystem #NYPolitics

Mediation-arbitration is a great process option for many, especially with the court backlogs we are seeing these days. Mediator-arbitrators can case-manage a matter efficiently and confidentially, while delivering a legally-appropriate outcome. But there are risks in contracting out of court and into private mediation and adjudication. Changes to Family Procedure Rules that came into force in April! The main focus of the amendment is to strengthen the powers that the family court has to “stay” (pause) court proceedings in order to give the parties the opportunity to engage in a non-court dispute resolution (NCDR) such as mediation. Our #FamilyLaw Partner, Adele Woods, has written an article to explain the amendments in more detail: https://lnkd.in/eNDTBe3N #EastMidlands #LawFirm

Legal and Compliance Insight! Recent New Jersey Supreme Court decision has significant implications for commercial property owners. The court ruled all commercial landowners -- including owners of vacant commercial lots -- have a duty to maintain the public sidewalks around their property in reasonably good condition, and are liable to pedestrians injured as a result of their negligent failure to do so. This decision highlights the importance of ensuring your property -- even if they are vacant -- are maintained and compliant with local standards. #PremisesLiability #CommercialProperty #LegalUpdate #InsuranceCompliance #WatchYourStepLiability https://ow.ly/O60f50SjSXg
