As proceedings unfold in the South Jakarta District Court, the legal community has rallied in a strong show of solidarity. A group known as the Komite Solidaritas Advokat Indonesia untuk Keadilan (the "Komite") has emerged, comprising 79 lawyers who've issued a clear warning to the court: an assault on one lawyer's rights is an assault on all. The Komite underscores a fundamental legal tenet: ultimum remedium — criminal law should only be the last option. In Kenny's case, there's no evidence of ethical misconduct, suggesting that the criminal charges are excessive and damaging. Typically, such ethical concerns should be addressed by professional bodies like the Advocates’ Honor Council before resorting to criminal courts. This case transcends Kenny's personal circumstances, posing broader questions about lawyers' freedom to provide candid advice without fear of reprisal. Kenny's legal opinion pertained to a particular loan agreement, illustrating the complexity of legal counsel. Criminalizing professional judgment could set a perilous precedent, causing lawyers to doubt their actions. With the trial ongoing, eyes from both within and outside the legal profession are fixed on the outcome. The South Jakarta District Court has a chance to deliver a precedent-setting verdict that could either bolster or weaken the integrity of legal practice in Indonesia.
