For a lot of companies, 2023 is much about adjusting their team and expectation towards the market, most often it means downsizing their team and form a more agile approach. So is the in-house legal market. The head level legal officers are quite stable in general for multinational companies in China, the new positions would normally come as a result of a spin off or a restructuring on the legal and compliance department. For Chinese companies, they are more active in attracting candidates from international law firm or MNCs as their overseas expansion grows or positioning themselves as truly international players. Most GCs felt they have shifted a signficant focus on compliance in recent years. Companies expand their compliance scope to areas like data privacy, sanctions, trade compliance. We see a raise in demand for compliance lawyers especially at top level, and strong need for them to be able to really understand business and operations, and influence/manage senior stakeholders. The market will be more active especially on the mid to senior level candidate side, as the need to step up and further strengthen their capabilities, reach out if you want to further discuss on this. #legal #inhousecounsels

I have a new writing hobby on Medium. Hoping to keep it up and develop more interesting content. I was inspired to write this piece because while I was implementing Data Protection laws in Malaysia, I drafted standard clauses for vendor contract managers to incorporate into vendor agreements. With some push back from overseas vendors, they had no idea how to proceed and expected hand holding. The era of the relentless lawyer solely focused on ‘winning’ by overpowering the opposing party with unfavorable terms is now behind us. The modern lawyer is focused on building sustainable business partnerships through alignment of goals and mutual benefit while complying with regulations. Consider a flourishing online retail company that gained rapid success due to its innovative products, efficient sales strategies and rode high on commercial and technical achievements. On many occasions, sales were closed by direct sales and product delivery. Bypassing legal counsel in making key decisions, the company prioritised speed over legal diligence. What is the cost of an employee deleting WhatsApp messages after learning of a regulatory inspection? In the case of a EU competition inspection, it is €15mn. Perhaps a case study for all companies and arguably should be covered during induction and annual training?? The European Commission fined International Flavors & Fragrances Inc and International Flavors & Fragrances France SAS (IFF) in June 2024 after it discovered that a senior employee at the company intentionally deleted WhatsApp messages during an antitrust investigation. These messages were part of a conversation with a competitor and contained business-related information, the commission found. They were also deleted after the employee learnt of the inspection at the company’s offices, which took place in March 2023. This was the first time the commission had fined a business for the deletion of messages on an app such as WhatsApp. Now think about this is terms of a financial services inspection/investigation. https://lnkd.in/eGcSKZGE

It was inspiring to gain fresh perspectives at the Deutsche Börse Global Compliance Offsite 2024. Sophie, Florian and I were grateful to be invited to join the offsite, capturing great moments of our two amazing two days together. It was a great opportunity to dive deep into the most pressing topics of Compliance and to get to know colleagues from all around the world. Compliance is truly much cooler than it might sound, and we were amazed to once again feel the spirit of our #OneGloablTeam. Here are our key takeaways: 1. Compliance Culture: While Compliance is necessarily linked with a notion of control and regulation. But this image is incomplete. Our compliance colleagues are enablers and supporters of our business success. To bring this message forward and to invest in the compliance culture of a company is vital. 2. Global team: Our Compliance area is a prime example of how more than 180 colleagues who work at our locations around the world, have many different nationalities and are supporting different business areas are working together to drive our company forward. To experience this spirit of togetherness was great. 3. Looking to the future: We learned a lot about how new technologies might define working in Compliance. Nonetheless, there is a willingness to handle new technologies, to embrace change and to actively create the future of work together. Thanks to Marc his Senior Management team (Marco, Miriam, Dr. Heiko Drebes and Michael), Patrycja and Astrid as well as to the entire Compliance team at DBG for this unique experience.
