Airports today in many regions are under threat of closure or restricted access, specifically the protections provided in the 1990 Noise and Capacity Act (ANCA). The industry needs to collaboratively encourage the FAA to take a firm stand on enforcing all provisions of ANCA. Such to protect against efforts by local governments to prevent aeronautical modernization and development, change key land use designations to non-aeronautical, limit aircraft operations and impose new noise restrictions that would be deemed discriminatory and in violation of the airport’s federal grant assurances. The economic health of communities, protection of general aviation airports and preservation of our national airspace system depend on it.

New decision from the Court of Justice of the European Union on air passenger rights in the case Matkustaja A v Finnair Oyj (C-385/23). The CJEU held that the occurrence of an unexpected and unprecedented technical failure which affects a new model of aircraft recently put into service and which leads the air carrier to cancel a flight falls within the notion of "extraordinary circumstances", when the manufacturer of this aircraft recognizes subsequent to this cancellation that this failure was caused by a hidden design defect concerning all aircraft of the same type and affecting flight safety. #aviation #airlines #passengerrights #flightdelay #flightcancellation #flightcompensation #aviationlaw #airlaw
