🚀 The 2024 volume of the ICCA International Council for Commercial Arbitration Yearbook Commercial Arbitration is now available on #KluwerArbitration: https://lnkd.in/eFT5twkt. We would like to thank the ICCA team, Stephan Schill and the Permanent Court of Arbitration (PCA) for making this update possible! 🎯 The 2024 volume contains a selection of 120 court decisions from 33 countries and one jurisdiction, the European Union, made accessible by abstracts, translations, in-depth indexing tools, and categorised lists. 𝐇𝐢𝐠𝐡𝐥𝐢𝐠𝐡𝐭𝐬 𝐨𝐟 𝐭𝐡𝐢𝐬 𝐲𝐞𝐚𝐫’𝐬 𝐯𝐨𝐥𝐮𝐦𝐞: ◾ A section on the 1958 New York Convention, featuring 67 cases from 27 countries, with first-time entries from Georgia and Nepal. This brings the cumulative total to 3,014 decisions across 99 countries and three jurisdictions—the Caribbean Community, the European Union, and the Iran-US Claims Tribunal. ◾ Coverage of decisions from the 1961 European Convention, the 1965 ICSID Convention (with first-time entries from Malaysia and Tanzania), and the 1975 Panama Convention. ◾ Extensive reporting on 41 additional decisions from a diverse range of jurisdictions. Enforcing foreign arbitral awards in Thailand is possible since it is a contracting state of the UN Convention on the Recognition and Enforcement of Foreign Arbitral Awards. However, according to the Arbitration Act BE 2545 (2002), courts may refuse enforcement if the award conflicts with public policy. In a recent case, the Supreme Court set aside an award due to procedural errors that violated public policy under the Arbitration Act. This decision was based on the fact that the arbitrators rendered the award despite the court having accepted a request for rehabilitation which ultimately led to the annulment of the case. This example underscores the importance of ensuring legal compliance throughout arbitration, particularly concerning Thai bankruptcy laws. It also emphasizes the necessity of consulting with Thai counsel early in the process to mitigate challenges in enforcing foreign arbitral awards in Thailand.
