𝐇𝐢𝐠𝐡𝐥𝐢𝐠𝐡𝐭𝐬 𝐨𝐟 𝐭𝐡𝐢𝐬 𝐲𝐞𝐚𝐫’𝐬 𝐯𝐨𝐥𝐮𝐦𝐞: ◾ A section on the 1958 New York Convention, featuring 67 cases from 27 countries, with first-time entries from Georgia and Nepal. Enforcing foreign arbitral awards in Thailand is possible since it is a contracting state of the UN Convention on the Recognition and Enforcement of Foreign Arbitral Awards. However, according to the Arbitration Act BE 2545 (2002), courts may refuse enforcement if the award conflicts with public policy. In a recent case, the Supreme Court set aside an award due to procedural errors that violated public policy under the Arbitration Act. This decision was based on the fact that the arbitrators rendered the award despite the court having accepted a request for rehabilitation which ultimately led to the annulment of the case. This example underscores the importance of ensuring legal compliance throughout arbitration, particularly concerning Thai bankruptcy laws. It also emphasizes the necessity of consulting with Thai counsel early in the process to mitigate challenges in enforcing foreign arbitral awards in Thailand.
