Just wrapped our recent webinar, "Clearing the Air: What You Need to Know About Greenhouse Gas and Its Reporting." We looked into the essential aspects of GHG sources, their impacts, and the importance of reporting GHG emissions. The IRA mandated that Subpart W be revised to more accurately reflect total methane emissions because studies have shown [https://lnkd.in/gEs6j7MP] that bottoms-up CH4 emissions estimates underestimate reported annual CH4 emissions. They suspect this is mainly attributable to "large, often episodic emissions." So, if you find an otherwise unmonitored large release event (>100 kg CH4/hr), you need to assume that it started at the date of last survey or 182 days ago, whichever is shorter. With the Waste Emissions Charge, that can get very expensive. Specially focused on current methane emissions

The Supreme Court cleared the way for methane regulations, closely linked to the methane fee passed as part of the Inflation Reduction Act, to continue. The regulations were announced in December, and will reduce emissions of the gas by 80 percent between 2024 and 2038. 24 Republican-led states had asked the Court to halt the regulations. We have discussed the methane fee in our dialogues, and written about it in our blogs. It is structured to rely heavily on the regulations; i.e. facilities in compliance with the regulations would not owe any fee. Though the order was unsigned, it seems possible that because Congress anticipated regulations in the enabling legislation, it stayed on the right side of the emerging Major Questions Doctrine being advanced by the current Supreme Court. This would not be the only consideration in the ruling, but it appears not to be a glaring weakness.
