$340M stadium project has flipped from Design-Build to Construction-Manager-at-Risk and the original general contractor has bowed out. This followed an announcement that the estimated time of completion had been pushed back one full year to 2027 due to supply chain issues. (Surprising to me, as I've heard most supply issues have ironed out since COVID). From conversations I've had over the last few weeks, most delays are attributable to the general contractor, and in this scenario the new general contractor has agreed to take on the liability of delays and spend over budget. +70% (!) of projects finish past the original scoped deadline. I do believe the new GC can make it work, but the odds are against them. With what sounded like a competitive bid process, I hope they haven't overpromised! https://lnkd.in/gatAscyz

Case Summary: A & V Building Solution Ltd v J & B Hopkins Ltd [2024] EWHC 2295 (TCC) In this complex adjudication case, the court clarified the allocation of adjudicators' fees and interest between parties. A & V Building Solution Ltd claimed £136,343.17, which included interest and fees for Mr. Blizzard. However, the court awarded only £17,400 for Mr. Blizzard's fees, stating that adjudicators’ decisions regarding fee liability are generally binding and final unless explicitly challenged in court. The court reinforced the principle set in Castle Inns v Clark Contracts Ltd, where the adjudicator's decision on fees cannot be easily overturned or adjusted post-ruling, highlighting the limited scope for appeal. A & V’s attempt to recoup Mr. Smith’s fees, which had been awarded to J & B Hopkins, was denied as no formal claim was made at the outset. Additionally, the judgment addressed interest under the Late Payment of Commercial Debts (Interest) Act 1998. The court determined that only specific sums, such as the measured works claim, were eligible for statutory interest, while other claims, like loss of profit and adjudicators’ fees, did not qualify under the Act. The statutory interest rate of 8% over the Bank of England base rate was applied, but A & V’s attempt to use a flat 13.25% throughout the entire period was rejected.
