Anton Kuchukhidze, the chairman of the Ukrainian Gambling Council, states that the legal gambling market is gradually approaching EU standards: "On January 16, the Commission for the Regulation of Gambling and Lotteries took another step towards simplifying the work of licensed gambling organizers in Ukraine. This time, the changes affected the issue of gaming equipment certification. Several European companies have been added to the list of entities that can carry out equipment certification. Against the background of these active efforts of CRGL to ease the regulatory environment, the fact of the opposite trend regarding the introduction of tax legislation is quite interesting". In her blog the Chairman of the Gambling Association of Ukraine and Deputy Chairman of the Ukrainian Gambling Council for Communication Viktoriya Zakrevskaya states that all over the world, lottery is a game of chance, and only in Ukraine it is not: "Today, when the entire civilized world considers lottery activities to be a part of the gambling market and lotteries in all countries pay license fees, taxes on gross gaming revenue (GGR) and adhere to the rules and principles of responsible gaming, Ukrainian realities guarantee lottery operators an exceptional position outside the general rules. This can only be explained by the interest of some MPs in preserving the status quo through certain financial incentives. The Gemeinsame Glücksspielbehörde der Länder (GGL) has indeed been active in addressing gambling legislation violations. Since the beginning of 2023, they have received over 1,500 complaints through their official website. These complaints are split evenly between illegal operators and irregularities in the work of legal operators. During this period, the GGL has investigated more than 1,860 websites of illegal operators and affiliates, checked 438 operators for illegal activities, and ordered 133 operators to leave the market. Out of these, 63 operators have complied with the orders. However, there is some skepticism about these figures. In July, the GGL estimated the gray market segment to be only 4% of the total Gross Gaming Revenue (GGR), which surprised even their colleagues and partners. Great panel happening International Masters of Gaming Law conference right now moderated by Jeff Ifrah discussing sports integrity in the betting context - something that was shared that I hope everyone keeps in mind: before legalization, no illegal bookmaker was out there alerting customers and leagues when matchfixing or other illegal activity was occurring. They also weren’t out there delivering problem gambling resources to players when they needed it. If we see an uptick in identification of suspicious activity in sports in the post-legalization era, it’s because we’re actually identifying it and calling it out. The system is working. The same concept will apply to igaming - pulling people out of the THRIVING black market will let us provide consumer protections and problem gambling resources that no offshore site is providing now. The highest likelihood of cannibalization with legalized igaming is of the black market.
