Turns out it's harder than you think to find the free image you really want to make your list of new jobs seem witty and perfectly on-point. Luckily the makers of the ever reliable Suzuki Swift are far more relaxed about these things. This week has been somewhat of a revelation on the new vacancy front. It's too early in the year (and probably not entirely correct) to say everything is returning to normal but these roles have all gone live in the last 5 days: - Commercial litigation, 2-5 years at a top-tier firm who probably haven't recruited in anger for the last 6 months - Employment law, 3-8 years at the same firm (and there's actually an identical role at another top-tier by pure coincidence) - Funds/FSR, 2-5 years with a fantastic small team who pay all the money as well as being nice to you - Competition, 3-6 years with a team who seem to not have any competition when it comes to winning awards - Insurance Litigation, 2-5 years with a genuine top-tier firm, not a top-tier insurance firm, actually one of the 6 firms anointed as top-tier (by someone old) We are certainly turning a corner so if you've crawled this far into 2024 and still can't shake off the feeling that you and your boss really should never, ever have gotten back together - call me on 0411 857036 or email me at matt@montgomeryadvisory.com.au

Defense lawyers can't fix stupid. I have had a lot of success litigating premises liability cases against various companies over the years. My success hasn't come from complex or novel legal strategies or anything like that. My success has come from the dumb employees that work for the Defendant. It's funny because many times the Defendant (and their insurance overlords) will hire top-tier law firms to represent them in the case. Lawyers with admirable legal pedigrees and significant trial experience. But unfortunately (for the insurance company) Defense lawyers can't fix stupid. I had a case where the lawyer from a big fancy firm, (Old White Man, White Man, & Associates) filed a well-researched and thoroughly written motion for summary judgment on a "rainy day" slip and fall case. Unfortunately, Defendant's employee testified, "Yeah, I knew the floor was wet before the customer walked it, but I didn't clean it up because I was busy and that's someone else's job to clean the floor." That motion was denied and we proceeded to trial. Another case, a lawyer from an even fancier defense firm (Even Older White Man, White Man, & Associates) filed a well-researched motion for summary judgment as well. Unfortunately, the discovery revealed that shortly after my client was injured, the Store Manager called my client on the phone and said, "Well, I guess one of my employees must've put the (50 lbs object) on the wrong shelf and it fell on you." That motion was denied and we subsequently settled for a reasonable amount. So the moral of the story is: never be intimidated by how many lawyers the insurance companies throw on a case or even how experienced opposing counsel is. The key is to dig deep and reveal how an employee's screw-up caused your client's unnecessary injury. Because Defense lawyers can't fix stupid.

When employers don't have this insurance, it can cost them big time if they ever run into legal issues. Employment practice liability insurance (EPLI) is a type of insurance that protects a company if they should ever find themselves getting sued by former employees, vendors, or job applicants. EPLI will pay for court costs and attorney fees. However, when an employer does NOT have this insurance (which we observe quite often), the legal expenses come out of their personal pocket. I've been around the litigation game for a few years, but I've recently expanded my practice to take on more cases. But I don't have unlimited bandwidth. That has made me think about what I'm REALLY good at, both in litigation and in the courtroom. I want to ensure that I can provide the BEST possible service and outcomes for clients. I have to make sure that I'm taking cases that have the biggest ROI for both the client and the firm. Here's what I'm REALLY good at: 1. Insurance Coverage: This has been the bulk of my caseload since I was Licensed Legal Intern. I've handled more than 100 insurance bad faith cases, ranging from uninsured/underinsured motorist, homeowner's, disability, and commercial (GL and property). Most have been for plaintiffs, but a few for defendants. Having this unintended focus has allowed me to sharpen my knowledge of the applicable law and continuously refine my strategy. 2. Contract Disputes: Yes, insurance bad faith cases are a type of contract dispute. But what I've learned is that having a strong background in bad faith cases has translated to other types of contractual disputes. A lot of the same law applies. I've helped several businesses and individuals over the past year in a variety of contractual disputes, beyond insurance. 3. Personal Injuries/Wrongful Death: Having a complicated medical background myself makes me incredibly curious when it comes to injury and death cases. I want to learn everything possible about the medicine and the science behind what occurred. Biomechanics? I'm in. Neurology? Let's do it. Hire a former NASA Astronaut to do an accident reconstruction? Done that before and would 1000% do it again. The human in me wants to then take that knowledge and understand how it effects the daily lives of the plaintiff and their loved ones: Can they work? Can they play with their kids? Can they tie their shoes? And, most importantly, if they can do any of those things, how painful is it? If anyone wants to team up on a case, HIT ME UP! I'm undefeated at trial. 😎 No, really. I am. Why do clients refer others to your personal injury law firm? I believe the main reason is customer service. Clients like to be updated on their case and have their calls returned the same day. They want to be aware of what's going on at every stage of the case. Just today one of my clients told me that he liked the way I kept him aware of the status of his case. Do you keep a log of each client and the different aspects of a case? I use Excel to keep track of different stages of a case. I also have a case log with notes for each conversation I have with clients, insurance adjusters and medical providers. With great attention to detail and exceptional customer service, clients will gladly refer others to your law firm.
