Update for Aesthetic Providers in Australia 🇦🇺 The Therapeutic Goods Administration has introduced new restrictions that impact the marketing of medical aesthetic products online. According to the TGA, influencing consumers about the use or supply of prescription medicines through advertising is now prohibited. This includes popular cosmetic substances like botulinum toxins and hyaluronic acids. Phrases such as "wrinkle-reducing injection" and "dermal fillers" are no longer permissible. While these changes technically took effect in December 2023, guidance documents were released late January. The restrictions are coming out faster than the guidelines! Prohibitions: The code bans expensive foreign trips, monetary grants, gifts, and hospitality like hotel stays for healthcare professionals from medical device companies. Ethics Committees: Medical device associations are required to establish an ethics committee for marketing practices and publish procedures for complaints on their websites. Product Approval Requirement: Medical devices cannot be promoted before receiving approval from regulatory authorities. Safety Claims: Companies must avoid using the term "safe" without qualifications and cannot claim that a device has no adverse consequences. Transparency Requirements: Medical device firms must disclose details regarding the distribution of evaluation samples and expenses related to conferences and workshops. Previous Controversy: The move follows allegations against Micro Labs for distributing significant freebies to doctors during the pandemic, which the company denied My Musings : Code is fine. Who will enforce it ? How can market place comprising of various stakeholders lodge the complaints and to whom they can lodge complaints ? Why the Code covers only Exhibitions, Conferences ? One important part the Code has left out is the huge marketing budgets the products companies are giving to various media magazines to promote their product stories. This has to be brought under code web. It's important. Too many marketing magazines doing "Stories" on "Quality" and "Safety" of the Products when none of the media houses know what it means. Another one the code has left out in the spec is inclusion of the the key word "Quality" too. Too much liberal use of "Quality" tags along with "Safety" tags used in promos at market place. Claims on Quality and Safety - both should be brought under Marketing Code. This Code should also establish linkages to the Regulations on Misleading Advts introduced by Consumers Affairs Ministry .
