Up to now, the traditional approach in respect of collective agreements was that the civil courts do not have jurisdiction in respect of the interpretation or application (inclusive of breaches) of collective agreements – e g Aucamp v South African Revenue Services [2014] 2 BLLR 152 (LC) and Ekurhuleni Metropolitan Municipality v South African Municipality Workers Union [2015] 1 BLLR 34 (LAC). The supreme court of appeal recently, in MEC for Economic Development, Environment and Tourism, Limpopo v Leboho (2022) 33 SALLR 281 (SCA); (2022) 43 ILJ 2695 (SCA), adopted a very different approach that, as is apparent, will in future have an important impact as to the dispute-resolution path selected by a party who alleges non-compliance with a collective agreement. This project examines how Māori land passed into Pākehā ownership and the stories surrounding it. The report includes: 💥 Evidence from 13 Hui-a-Rohe, throughout the motu, gathering collective rohe voice through wānanga, addressing two focus questions - what has the kōhanga journey been like, and, what are the opportunities for growth and development; 💥 Evidence from 77 e-Submissions from kōhanga, identifying the top 3 issues they think kōhanga are facing, and their proposed solutions to them; 💥 A literature based PESTLE (Political, Economic, Social, Technological, Legal and Environmental) review and analysis of the external operating environment the movement operates in; 💥 A public policy review and analysis of the Kōhanga / Crown relationship; 💥 Review and analysis of the recommendations of previous reviews of Te Kōhanga Reo including: Government Review of TKR 1987-88; Pere and Puketapu Review 1990; Māori Affairs Select Committee Inquiry into Māori Participation in ECE 2007-8, reported to Parliament; Wai 2336 Kōhanga Claim; Ngā Tuara Whānui TKR Governance Review, 2013; and, the Sir Michael Cullen Report 2014.
