Update on Estate planning/Probate forfeiture rules vis-à-vis Assisted Dying The recent High Court ruling pleased me... a lot 😀 ... and I want to share it with you: "Accompanying deceased to Swiss clinic does not by itself amount to assisting suicide", says England and Wales High Court (EWHC) and allows the widower to inherit the estate of the deceased! Background: For two years, she had been suffering from the incurable degenerative neurological disorder Multiple System Atrophy. The coroner at her inquest noted that her condition had deteriorated to the point where she had little enjoyment from life, was in constant pain and found it very difficult to cope. It was accepted by all parties that the deceased ended her own life by self-administration of an overdose of pentobarbital. To do so, she had obtained assistance from Pegasos clinic staff and her husband and two adult children. The forfeiture rule as codified in the Forfeiture Act 1982 would prevent the claimant from inheriting the assets the deceased left him. Accompanying the deceased may sometimes be part of a course of conduct that indicated intent to assist, this would not necessarily be the case. The family's only intention in being there was to provide comfort to the deceased by their presence and nothing they did was capable of encouraging her death by suicide, the court said. Accordingly, their interests in her estate are not forfeit. A good outcome in my view #Assisted-dying, #lastingpowerofattorney#LPA#Wills#inheritance#inheritancetax#estateplanning#probate tps://

I wouldn’t know how to start a petition and don’t think it would make much difference as the governments direction on most questions is largely to blame others. However this rape gang issue has been festering and as I find out bits of information about what’s actually been going on I find it very hard to understand why any block on an inquiry would benefit anyone apart from the perpetrators. Safeguarding our children, whatever race, has to be top of the agenda. And those who committed these crimes, aided these crimes, covered up these crimes, avoided to take action on these crimes is just as complicit as the offenders themselves. I haven’t found a petition and to be honest I don’t want to see the graphic detail of these barbaric acts towards the victims. What I have heard so far (may or may not be true) is truely horrible. However the scale, detail and facts of the matter need to be exposed so we the public can guide our officials to take the required action and bring all of those who supported these crimes to justice. We should have a zero tolerance approach to this subject and failure to act shall split communities and hurt the safety and freedom we here in the U.K. hold dear. Children in the UK seem to be at risk. I call on all safeguarding and children services to make it very clear to government officials the severity of the issue. Unfortunately I believe the issue to be far worse than we know. Possibly the sadest post I’ve written. But as a dad of three children I cannot sit by and do nothing. We have a police force that should be the best in the world and a 1st world justice system that should be feared by criminals. Our democratic political system (currently being torn up) should be able to enforce safety for all, a military that protects our way of life. But we the people don’t seem to have a voice and now more than ever should be using that voice and fair justice process to convict these criminals and more importantly protect our young people.

IMPACT OF AGE ON WRONGFUL DEATH SETTLEMENTS The settlement tends to be higher if the deceased was young and potentially had several decades of productive life ahead. Conversely, cases involving young children may result in comparatively lower compensation due to uncertainties. Elderly victims’ families may receive comparatively lower settlements, especially when the victims are retired. If a member of your family has died as the result of someone else's negligence, you may be able to pursue compensation in court. In California, staff in long-term healthcare facilities and other care facilities for the elderly are mandated reporters for elder abuse of all kinds, including financial elder abuse. While those personnel are trained on what to look for, family and friends are often unaware of telltale signs that an elderly loved one is being taken advantage of financially. Worse, outside of an institutional care setting it can be difficult to have reliable oversight over a caregiver’s actions. By the time the wrongdoing is discovered, substantial harm may have already been done. What should a family do if their loved one has been a victim of financial elder abuse? Seek legal help as soon as possible. It is possible to undo alterations to a victim’s estate plan or transfer documents if they were made under duress, through extreme pressure, and when the victim lacked testamentary capacity. It is imarative to act quickly to protect from further harm and to reverse the damage that has already been done. The attorneys at NM Law can help evaluate your claim of financial elder abuse and determine your best course to pursue justice. Is a ‘Life’ Sentence of 52 years really Justice for the Victims ? The recent conviction of Alex Rudebukana for the Southport murders, with a life sentence and a minimum term of 52 years, brings into focus the difficult and often painful questions about justice for victims of the most heinous crimes. Rudebukana will be in his 70s when eligible for parole, while his victims, in their 50s, will likely be forced to endure the trauma of repeated parole hearings. This cruel cycle is often exacerbated by left-wing liberal lawyers and activists arguing for the “rehabilitation” of these offenders. We’ve seen this before in cases like Nicholas Vernage, who brutally killed three innocent people, including a police officer, in a savage knife attack, and Harry Roberts, who murdered three unarmed police officers in cold blood. Both were sentenced to life imprisonment, with the public expectation they would never be released, yet they were eventually released despite the appalling nature of their crimes. Roberts served 48 years before his release, and Vernage is now being considered for release. Similarly, Patrick Magee, responsible for the Brighton bombing that killed five and sought to assassinate a Prime Minister, and Brian Whitelock, who went on to kill again after release, demonstrate how the system can fail victims by prioritising the hypothetical rehabilitation of offenders over public safety and justice. The families of victims are repeatedly retraumatised, forced to relive their worst nightmares while offenders are painted as reformed individuals. We must ask: where is the justice for those whose lives were so brutally taken? Where is the fairness for families who are left to pick up the pieces? It is time to rethink the parole system for the most appalling crimes. Life must truly mean life in cases of such extreme brutality and loss of innocent lives. Otherwise, the justice system risks failing those it is meant to protect and serve.

In Florida, wrongful death claims can result in various types of compensation aimed at addressing the losses suffered by the deceased's family and estate. The common types of compensation in such claims include: - Medical Expenses - Funeral and Burial Costs: This is reimbursement for the expenses associated with the funeral, burial, or cremation services. - Loss of Income: Compensation for the lost wages and benefits the deceased would have provided to their dependents if they lived. - Loss of Support and Services - Loss of Companionship and Protection - Pain and Suffering - Loss of Parental Companionship, Instruction, and Guidance - Punitive Damages - Loss of Inheritance The exact types and compensation amounts will vary depending on the case's specifics, the claimant's relationship to the deceased, and the extent of the financial and emotional losses suffered. After a death caused by the negligence of a responsible party, the legal process can be complicated for family members to understand. Unbelievable Injustice: Why Won’t Rachel Mitchell Pursue Justice? Learning that the case against the employee who allegedly raped and impregnated a patient at a long-term care facility was turned down with no felonies filed is shocking. The people of Maricopa County deserve more than the evasive answers given by my opponent. Someone impregnated an incapacitated woman and won’t be held accountable. Most troubling, we do not know why. Was a DNA test completed? Will it be done at some point? Isn’t it the job of the County Attorney to protect our most vulnerable? Clearly, this poor victim did not consent. Victims deserve better. Our community deserves change in our top prosecutor’s office. My vision for this office is clear: When tough decisions are made, I will answer to the people of this county and provide the necessary information so the public is as comfortable as possible with the reasons given. We deserve transparency and a top prosecutor who can answer the tough questions. It's time for accountability. It's time for change. Vote for me, Gina Godbehere, for Maricopa County Attorney. #JusticeForVictims #Accountability #Transparency #MaricopaCounty #GinaForJustice #TimeForChange MCAO turns down case against employee who allegedly raped, impregnated patient at long-term care facility https://lnkd.in/e-vETPRV
