Something to be aware of: Today's (or actually yesterday's) #telecoms news is that the private Access to Telecommunications Network Bill is to receive its second reading on 26th January 2024. This Private Members' Bill seeks to incentivise the sharing of apparatus between operators and to encourage network roaming to fill "not spots" in rural areas. This proposal is intended to supplement the Shared Rural Network. It is to be noted that in 2018, a similar proposal was considered by OFCOM but not in the event pursued. Given that it is a Private Members' Bill, (1) all that is required at this stage is a short and long title (rather than a fully drafted bill), and (2) its statistical prospects of becoming law are not very good. There is no text as yet to tell us exactly what the Bill is intended to do, as far as I can tell, so it is hard to tell what it is intended to do in addition to the Access to Infrastructure Regulations 2016 (ATI) so far as physical kit is concerned. The Telecommunications Bill, 2023 was introduced in Lok Sabha on December 18, 2023. It seeks to regulate activities related to telecommunication. It repeals the Indian Telegraph Act, 1885, the Indian Wireless Telegraphy Act, 1933, and the Telegraph Wires (Unlawful Possession) Act, 1950. It also amends the Telecom Regulatory Authority of India (TRAI) Act, 1997. Fundamentally this bill is aimed at shaking up India's telecom scene. Key changes include stricter government control, with prior authorization needed for services, networks, and even equipment. Spectrum allocation will be primarily through auctions, tightening the government's grip. User rights aren't forgotten, though, with Do Not Disturb features and grievance redressal mechanisms. A dedicated Rural Telecom Fund aims to bridge the digital divide. The Central government has notified that certain provisions of the Telecommunications Act, 2023 shall come into force from June 26, 2024. Under the present arrangement, the telecom department issues over 100 types of licenses, registrations and permissions. The Act aims to streamline this process by consolidating many of these into a single authorisation mechanism. BREAKING THE TELECOMMUNICATIONS ACT, 2023 The Telecommunications Bill, 2023, received the assent of the President on Sunday (December 24) and the bill has now been enacted into law. The law will now allow the government to temporarily take control of telecom services in the interest of national security and also provide a non-auction route for the allocation of satellite spectrum. It extends to,— (i) the whole of India; and (ii) to any offence committed or contravention made outside India by any person, as provided in this Act. (3) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint and different dates may be appointed for different provisions of this Act and any reference in any such provision to the commencement of this Act shall be construed as a reference to the commencement of that provision. It also allows the government to take possession of a telecom network in case of a public emergency or in the interest of public safety.
