Our Energy Regulation & Litigation team shares 10 issues we are monitoring under Trump 2.0. Top questions in my own mind are: (1) What will happen with the DOE Loan Programs Office and the money it is designated to administer? (2) How many offshore wind projects will move forward in the next four years? (3) Whether and how Pres. Trump will take concrete action in support of data center generator co-location? #energypolicy #uspolitics Swan Song On the prospect of major permitting reform in the US. Doomberg "“We shouldn't accept mediocrity as the best a politician can do.” – Joe Manchin In October of 2015, Mountain Valley Pipeline, LLC, filed an application with the Federal Energy Regulatory Commission (FERC) to build a pipeline connecting the prolific shale gas fields of Appalachia to the broader network of energy infrastructure in the US Southeast. The Marcellus Shale was producing vast quantities of natural gas, swamping local demand, and off-take capacity from the region soon became a serious constraint. Investors backing the Mountain Valley Pipeline (MVP) project were ready to risk their capital to resolve the market’s needs, anticipating that MVP would go into operation in late 2018. The application was countered with a torrent of lawfare funded by environmental groups that delayed construction by years, substantially increased costs, and nearly tanked the entire initiative. A literal act of Congress was required to finally settle the issue, with legislators taking the unusual step of specifically removing jurisdiction over the MVP project from activist courts. Six years late and hundreds of millions of dollars wasted, gas finally started to flow in mid-June:"

A recent High Court judgment created a new precedent in business energy commission claims. What does it mean to claimants? 🔸 You must prove there was no informed consent to the commission payment. 🔸 You must prove intentional wrongdoing by the broker agent. 🔸 The ruling reinforces the 6-year limitation period for bringing claims. 🔸 The judgment provides a clear legal framework that may deter ill-founded claims. Overall, the ruling makes succeeding in energy sector commission claims more challenging and may discourage many claimants from pursuing these claims. Our team is ready to hear your case and provide the support you need to navigate these changes.
