Plaintiff's attorneys benefit the most from Nuclear Verdicts. ❔ Why? ❔ How? 💰 Follow the money. Plaintiff's attorneys are typically paid on contingency fees. They only get paid when they win. The bigger they win, the bigger they get paid. What is 40% of a $20,000,000 verdict? What is 40% of a $100,000,000 verdict? I am just a defense attorney, but even I can do that math. ❔ Who also benefits? Plaintiff's retained expert doctors benefit, especially when they treat on a lien or under a letter of protection. Are litigators truly facing down "12 Angry Men (& Women)" each time they take a case to a jury? The incidence of massive "nuclear" verdicts has unquestionably increased, but inevitably the blame gets laid at the feet of "Reptile Tactics" (thoroughly debunked) or "class warfare" (unsupported by data). Anyone who has watched mock jurors knows that large damage awards are generally the outcome of one or two outraged and outspoken jurors rather than an entire angry group. Usually, it's a confluence of circumstances that leaves the remaining jury unmotivated to push back against the enraged juror(s). No juror wants to be the one who defends heinous conduct or the bumbling corporation. Careful jury selection processes and understanding the seated panel are the keys to avoiding the above outcome. #jurytrials #litigation https://lnkd.in/epsumjrj
