The 2024 Paris Olympics will commence in 100 days, and the selection processes for determining which athletes will represent Australia are in full swing. For individual athletes who are not selected, selection policies of National Sporting Organisations and the Australian Olympic Committee provide athletes' with the ability to appeal their non-selection based on a limited number of procedural grounds to resolve what is known as a ‘selection dispute’. I am pleased to share my article which has been published in the latest edition of the Australian + New Zealand Sports Law Association (ANZSLA) Commentator. This article focuses on the decisions of Australia’s National Sports Tribunal (‘NST’) to give insight into the resolution of selection disputes in the Australian context, and the applicable legal principles and issues which have emerged. The article reviews the published NST decisions relating to each of the four commonly available grounds of appeal, and outlines the consequences for when a Tribunal finds a ground of an appeal to be successfully made out. 2024 BRICS Games The 2024 BRICS (Brazil, Russia, India, China and South Africa) Games will be held in Kazan on June 12-23 and will feature events in 20 different sports. In mid-May 2023, Russian President Vladimir Putin instructed the government to submit proposals for organizing and holding the 2024 BRICS Games in Russia. Oleg Matytsin, who served as the Russian sports minister at that time, emphasized later that the BRICS Games were not meant to rival any other competitions and would not interfere with the international sports calendar as well as with the IOC-approved calendar of events. In April, Russian Foreign Minister Sergey Lavrov paid an official visit to China, where he stated that the 2024 BRICS Games and the following World Friendship Games in Russia would be organized based on the principles enshrined by International Olympic Committee (IOC) Charter. 2024 World Friendship Games Moscow and Yekaterinburg in Russia’s Urals region are slated to co-host the 2024 World Friendship Games on September 15-29. In December 2023, the International Olympic Committee (IOC) cautioned National Olympic Committees (NOCs) against participating in the World Friendship Games in Russia next year, as this would violate the global Olympic body’s recommendations. Last November, WADA chief Banka warned that certain sanctions could be in place against international athletes willing to participate in the 2024 World Friendship Games. He said in particular that: "The possible participation in those competitions of those who are parties to the WADA Code, may have certain consequences." Olympics and Paralympics: why should we believe the promises of positive legacy for host communities? With #Paris2024 about to start, stories emerge from Queensland that their bid included an a $1 billion upgrade of the Gabba stadium that was not supported by a business case. One of the problems with holding games organising committees (OCOG) to account for cost overruns and the legacies that remain (or not, like the legacy of cost blowouts), is that most OCOGs are rapped up within months of the event. Further, the past few events have seen political and social reshuffling that reduces the ability for post-event accountability of governments, bid committees and OCOGS (think Paris 2024 election, Beijing 2022 invasion of Ukraine, Tokyo 2020 COVID-19, Rio 2016 President impeached between events, Sochi 2014 invasion of Crimea...). Why should the voting public trust the budget estimates and legacy promises from those who bid for, and put on these wonderful events ? A bipartisan group of Senators and Representatives have introduced the Restoring Confidence in the World Anti-Doping Agency Act, which supports the recent decision made by the US Office of National Drug Control Policy to withhold the 2024 US membership dues for WADA because of WADA's highly questionable approach in addressing the doping allegations made against members of the Chinese swimming team in the lead up to the 2024 Summer Olympic Games. The legislation is supported by the US Anti-Doping Agency and leadership of the TEAM USA Athletes' Commission. The legislation would permanently cement in US law the authority of the ONDCP to withhold WADA membership dues pending WADA's implementation of institutional changes that would bring real oversight and accountability to WADA and restore the trust in WADA's ability to ensure the integrity of the Olympic and Paralympic Games. (To be sure, WADA and its operations and its rules have an extensive impact on elite, professional, and amateur competitive sports on a global basis beyond the OIympic and Paralympic Games.) https://lnkd.in/eMh48VhS
