Defunct & inequitable. Ireland’s current statutory PPO scheme for catastrophically injured victims. Indexation is the biggest inequity. Why should the future care and medical treatment costs of a catastrophically injured individual with 24/7 care needs be linked to the costs of a broad basket of consumer goods and services? New recommendations published in two expert reports this week approved by Minister for Justice Helen McEntee. Indexation will now be a combination of the Harmonised Index of Consumer Prices (HICP) (20%) and annual rate of change in nominal hourly health earnings (80%). Discount rates for future care costs (1%) and future financial loss (1.5%) remain unchanged. A new trigger mechanism to review the discount rate in the future may prove controversial for all litigation stakeholders seeking certainty. IMPORTANT - Medicare coverage is still often denied INCORRECTLY by applying the Improvement Standard--that is skilled-nursing coverage depends on improving functionality. The legal standard, confirmed in settlement of Jimmo v. Sebelius, is to MAINTAIN AN INDIVIDUAL'S CONDITION OR SLOW DECLINE. This distinction makes a HUGE difference for families.
