I am very pleased to share this year's final issue of Urรญa Menรฉndez and Philippi Prietocarrizosa Ferrero DU & Uria's #InternationalArbitrationOutlook. Together with Cristian Gual I contributed to the #IAO12 with an article on the recent decision of an ICSID annulment committee refusing to annul the award in ESPF et al. v #Italy. This decision hinges on the saga of intra-EU investment disputes under the ECT. The issue also includes terrific articles by my colleagues: Daniel Felipe Cristรณbal Garcรญa Clavijo and Blanca Marรญa Beltrรกn discussing the new #DraftProvisions on cross-cutting and procedural issues that UNCITRAL is working on. Jana Lamas de Mesa explores the reasons behind #Singapore becoming an #InternationalArbitrationHub; Josรฉ Marรญa Freile Franco and Martin Salvador Mora comment on the recent decision of the Constitutional Court of Ecuador on #ISAC with #CostaRica; Santiago Cruz Mantilla and @Esteban Lagos Gonzรกlez discuss a recent decision by the Colombian Supreme Court refusing to enforce an award based on #ECT against #Spain; Francisco Mateo Pavรญa provides a thorough explanation of the interplay between #HumanRights and #SportsArbitration; and last but not least, Alberto Fernรกndez Matรญa and Claudia Venecia M. provide us with the latest trends in the extension of arbitration agreements to #non-signatories. The full version of #IAO12 can be found at the following link: https://lnkd.in/dbAchPdR We hope you enjoy the papers and wish you all the best for the coming year!

๐ Mark your calendars for the next interesting and interactive YRAP event at Paris Arbitration Week, hosted by Sciences Po TADS and organised with Muลat & Asociaลฃii. ๐บ๏ธ Join us to discuss the role of international arbitration in steering trade and economic development. ๐ Statistics suggest that countries with arbitration-friendly policies see an increase in foreign investment and trade as a result. For example, ratifying the New York Convention has been found to increase a countryโs foreign trade by about half as much as joining the World Trade Organization. ๐ค So is there a correlation between a jurisdictionโs approach to arbitration and its effect on attracting foreign investors? What are the present socio-economic advantages (or disadvantages) of an arbitration-friendly jurisdiction? Why is it important to be established as a 'safe' or popular seat of arbitration? What are the different challenges that jurisdictions face, from promoting alternative dispute resolution to maintaining their position and staying competitive? ๐ค To find out, we will connect with a panel of diverse speakers and practitioners from multiple jurisdictions. With varied perspectives including from the CEE region, England & Wales, France, the speakers will reflect on their experience to find and emphasize the connection between arbitration and international trade. ๐ฅ The panel will be followed by a cocktail reception. ๐ Register here: https://lnkd.in/d277u9vr ๐Organisers: On behalf of YRAP Violeta Saranciuc, FCIArb Cฤtฤlina Bรฎzรฎc Liana H. Just in time to end the year with a bang! I'm exited to share this year's last issue of Urรญa Menรฉndez and Philippi Prietocarrizosa Ferrero DU & Uria's #InternationalArbitrationOutlook. My friend and coworker, Josรฉ Marรญa Freile Franco, and I write about the recent Opinion by the Consitutional Court of Ecuador deeming Investor-State Arbitration Clauses in the Trade Agreement with Costa Rica unconstitutional. Will this affect the future of #InvestmentArbitration in Ecuador? Read all about it and leave your impressions below! This #IAO12 also includes articles by my colleagues, including, Jana Lamas de Mesa de Mesa on #Singapore as an #InternationalArbitration hub; Santiago Cruz Mantilla and Esteban Lagos Gonzรกlez explain a recent decision by #Colombia's Supreme Court refusing to enforce an #ECT based award against #Spain; Francisco Mateo Pavรญa who discusses the interplay between #HumanRights and #SportsArbitration; Alberto Fernรกndez Matรญa and Claudia Venecia Martin-Lopez discuss the latest trends in extending arbitral agreements to #nonsignatories; Adriรกn Segura and Cristian Gual who analyse the #ICSID #Annulment Committee's decision in ESPF et Al v. #Italy, as part of the #IntraEU #ISDS saga and Daniel Felipe Cristรณbal Garcรญa Clavijo and Blanca Marรญa Beltrรกn on the recently published #DraftProvisions on cross-cutting and procedural issues in #ISDS that UNCITRAL #WorkingGroupIII is working on. We hope you find these articles helpful as the new year is approaching.

From 5 to 8 May, Hong Kong will host the ICCA Congress, the largest global professional gathering of the international arbitration community, attracting delegates from all over the world.ย It will be one of the most important conferences to be held in Hong Kong in 2024.ย We would like to invite you and your colleagues to join this exciting event. ICCA promotes the development of arbitration, mediation and other dispute resolution methods, through conferences, publications and projects to harmonise arbitration and conciliation rules, laws, procedures and standards.ย The last ICCA Congress, in Edinburgh in September 2022, attracted over 1,200 professionals from around the world, and we are expecting a similar attendance in Hong Kong โ from the local legal community here, as well as from across China and abroad. Organised by the Hong Kong International Arbitration Centre, the theme of the Hong Kong Congress is "International Arbitration: A Human Endeavour" โ a critical topic for all of us in international arbitration in a world of rapid political, cultural and digital transformation.ย There will be an Opening Ceremony on 5 May at the Rosewood Hotel, and a Gala Dinner on 7 May at the Hong Kong Convention and Exhibition Centre. We invite you to join us at ICCA 2024 to promote and share your thoughts on developments in arbitration with your international colleagues.ย Given Hong Kong's leading global position amongst arbitral institutions and proud history of innovation, there is no more appropriate venue in which to connect, collaborate and create solutions for the challenges ahead and we look forward to a strong presence from the Hong Kong community. You can register online, and read a snapshot of the conference programme. If your organisation is also interested in sponsorship opportunities for the Congress, please contact kcheng@hkiac.org.ย #internationalarbitration #arbitration #ICCA #AFSA #AFSAInternational #HKIAC #ICCAHK24

So the curtain drops on ICCA 2024 Hong Kong and 1,400 delegates disperse to 70 countries. The largest crowd in ICCA history, apparently. There was chat about the reasons for this. Post-Covid travel surge still operating? Growing engagement from China? A chance to visit HK for the first time in years (or ever, for some)? Or perhaps it reflects a point addressed by Prof Bryant Garth in his opening speech. #internationalarbitration grew from the vision and labour of a group of โGreat Menโ (the Profโs phrase) but was then developed and shaped in self-interested ways by a larger crowd of โtechnocratiโ at law firms in (primarily) US and UK. Through that evolution, arbitration became the primary choice for international trade and investment and a standard focus for growing numbers of law firms, consultancies, institutions, academics and arbitrators throughout the world. So perhaps the record crowd doesnโt need special explanation. It is just the product of that evolution. Arbitration has moved well beyond its historical aura of a specialist art for cognoscenti, to become a standard practice skill for anyone working in international contracts and dispute resolution around the world - and therefore bringing 1,400 people from 70 nations to an excellent, rewarding and well-arranged event in vibrant Hong Kong. Thanks to everyone who made it so enjoyable.
