🚨 As of today, workers across the UK hospitality sector will be taking home more, thanks to the new Tipping Legislation Act, which ensures that 100% of customer tips will go directly to staff. 💰 This law addresses the lack of transparency around tips and service charges, providing consumers with clarity on where their money is going and ensuring that workers are fairly compensated. 💬 Conor Sheridan CEO of Nory, shared his perspective: “The introduction of this Act marks a significant step toward ensuring greater transparency in the restaurant industry, not only for consumers but also for the frontline workers who are directly impacted by gratuity practices. It’s a win-win—customers gain clarity, and workers can trust that gratuities are distributed fairly." However, the new legislation could lead to higher menu prices as businesses navigate the pressure to maintain their margins. “Margins are already razor-thin, and with this new law in place, businesses can no longer rely on tips to plug the gaps,” says Conor. As the industry adjusts, the focus must shift toward building a sustainable and transparent business model—one that supports both workers and customers without compromising on quality. Hospitality survey findings published earlier this month by Fair Work Convention reveal that businesses within the sector continue to feel the pressure of increasing energy bills and supplier costs. Hospitality employers are also experiencing issues around retention and recruitment with almost three-quarters (71%) facing recruitment challenges and over half (53%) experiencing high levels of turnover. Workers responding to the survey on the other hand raised issues around the flexibility and predictability of hours and fairness in pay. With nearly half (48.1%) of all jobs in the sector being paid below the real Living Wage, we know that low pay continues to be a challenge within the industry. Simplify Fast Food Industry Award Interpretation Is Coming 🤔 The Fast Food Industry Award sets the basic standards for workers in Australia's fast food sector. It covers minimum wages, hours, leave entitlements, and other conditions for roles like kitchen staff, customer service, and managers. This award aims to guarantee fair treatment, resolve disputes, and uphold industry integrity. The Fast Food Industry Award sets out the minimum standards for workers in Australia's fast food sector, covering wages, hours, and leave entitlements for various roles like kitchen staff, delivery drivers, and managers. It includes provisions for full-time, part-time, and casual employees but excludes certain businesses like cafes and restaurants offering sit-down service. The award doesn't currently include shiftwork arrangements but details rest and meal break requirements. Wages are determined based on employee classification, with overtime and penalty rates outlined. Allowances for meals, cold work, and transportation are also specified. Leave entitlements, including annual leave, personal leave, and public holidays, are covered under the National Employment Standards. The Fast Food Award imposes numerous regulations on scheduling, closely related with payroll, to prevent errors and streamline administrative tasks from utilizing Workstem software. Third party benefits In a recent judgment, the EAT held that an employer could not rely on its contractual terms with a third party in order to withdraw certain benefits from its former employees.   After they were made redundant, a group of claimants argued that their employer’s failure to provide life-long travel discounts (operated by a third party association) was a breach of their employment contracts. As part of its defence, the employer contended that the claimants’ entitlement to such benefits had been withdrawn. It relied on a right of withdrawal in the agreement between the employer and the association, as well as a notification issued by the association to the employer withdrawing the post-redundancy benefits from those employed after a certain date.   At first instance, the tribunal found that the right of withdrawal had been incorporated into the claimants’ contracts and that their contracts had been varied by the association’s notification. The EAT overturned this on appeal. It held that the right of withdrawal in the agreement with the association had not been incorporated into the employees’ contracts – it was not enough that the claimants were aware that the benefits were operated by the association. The employer could therefore not rely on that right of withdrawal to remove the travel benefits. The case is a useful reminder of the importance of ensuring that appropriate wording on third party benefits (such as provisions noting where a benefit is contingent on a third party continuing to provide it) is included in express terms in employment contracts (Adekoya v Heathrow Express Operating Co Ltd) #employmentlaw #humanresources #thirdpartybenefits
