The workplan of the WES project, for the year 2024, was presented during the online 5th Steering Committee Meeting (SCM), on 01/02/2024. I received this email today regarding the meeting last week discussing the CDPHE WQC's proposed Colorado protections of state waters. You can follow the first link to view a recording of the session, and the second link near the bottom to view a summary of stakeholder comments. Thank you to everyone who attended the meeting on January 23 with Speaker McCluskie and the Colorado Department of Public Health and Environment to discuss legislative and policy options to address the U.S. Supreme Court's recent Sackett vs. EPA decision. We are pleased that nearly 100 people joined in person and 275 people joined virtually. The meeting recording is now available. https://lnkd.in/gbgttJSU During the meeting, we discussed legislative policy options. We will reach out with further information about future large group meetings. However, a large group meeting has not been scheduled. The Sackett v. EPA U.S. Supreme Court decision removed federal protection of wetlands and other waters. Under that decision, the type of waterbodies subject to federal jurisdiction and permitting is significantly narrowed. The U.S. Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers (Corps) thereafter revised their regulatory definitions of "waters of the United States" to align with the Sackett ruling. Currently, the Corps issues permits in Colorado for dredge and fill activities. With fewer federal permits being issued by the Corps following Sackett, rivers, streams, lakes, and wetlands in Colorado are at risk of irreversible harm. In addition, the decision leaves the regulated community with much uncertainty about the legal risk associated with their development projects (i.e., housing developments, flood prevention, etc.).
