A general agent had a family office client who, because of internal family dynamics, was going to lapse a policy because he didn’t want to fund it anymore. The original trustee had passed away and a dispute amongst family members left the new trustee in a position where funding the policy became problematic, thus his desire to stop the outflow of premium dollars and to make sure he maximized the value of the asset. Fact pattern: - Policy Type – Universal Life - Policy Issued – April 2006 - Face amount – $3,000,000 - Premiums paid – $930,000 - Cash Surrender Value – $0 - Insured – 96-year-old Female with no impairments After compiling medical records and policy-specific information, Melville Capital ran a competitive auction and obtained bids from several interested Institutional Funds. We delivered $1,120,000 NET to the trust (where they would’ve received $0 had they surrendered it), reclaiming all premiums paid into the policy. In addition, the trustee no longer had $300,000/year in ongoing premium payments, which was a current point of contention amongst the different constituents. The LS option can be useful to individual, trust or corporate life insurance policy owners as circumstances change – whether it's because of a divorce, the death of a beneficiary, estate/exit/succession planning, lifestyle or health changes, mergers & acquisitions, restructuring, bankruptcy, or one's kids have grown up.
