Were you affected by CrowdStrike’s blue screen of death? The flawed computer software update caused chaos worldwide, impacting airports, NHS services, TV broadcasts, online banking access, and even leading to unanswered 911 calls in the US. When hacking is the cause, there are clear legal ramifications. But what about faulty software? Are there any legal consequences? In the UK, Ofcom recently fined BT £17.5 million for a 10-hour network fault that affected 999 calls. Similarly, car manufacturers Volkswagen and BMW were fined €875 million for breaking EU antitrust rules. But the New York Times suggests there’s little incentive for software firms to prevent such incidents in the future. “The consequences for significant outages can be so minimal that companies are not motivated to make more fundamental changes” Instead, they can simply provide a software fix for the immediate issue and carry on. After all, we often sign contracts with software companies with exclusions for malfunctioning software updates. Yet potential lawsuits from business-to-business customers could prompt CrowdStrike and other major technology companies to reflect and improve their practices. Infamous today for a buggy software update that caused widespread corporate outages, including at airlines and medical facilities, the company gained fame for investigations and remediation of major hacks. As a result of becoming a gold standard for protecting corporate systems, it became a critical piece of the global tech infrastructure, magnifying the impact of a software flaw.

Delta Air Lines to sue Microsoft and CrowdStrike? Oh it does make me chuckle. If Delta Air Lines wants to sue anyone, they should sue the CISO that persuaded them to spend probably tens of millions of dollars on CrowdStrike bloatware. Had they opted to use the Microsoft protection *built into the OS* they would have had no problems. They opted not to, and now they're suing Microsoft? Oh the irony.... Hopefully the EU now reverses their idiotic diktat that Microsoft provides these companies access to the Kernel. A crusty veteran of Ma Bell once told me that telecom achieved 100% reliability asymptomatically by, among other things, deep redundancy and TTTA— test, test, and test again. Our predilection to rush things into production harms industry and causes material collateral damage. Yet, curiously, some hail George Kurtz (CrowdStrike CEO) as a folk hero and excuse Microsoft every patch Tuesday. If Boeing is held responsible for a door blown off an aircraft, it is similarly unconscionable to have forced thousands of passengers stranded for days, shipping lines losing millions, and medical care disrupted because software companies and their votaries bypass sound procedures. “Too big to fail” comes with a moral hazard over which no tech company should be custodian. It is instructive to study J & J CEO James Burke’s classic response to the “Tylenol murders” in 1982 as the model for crisis management and candor. There was no social media behind which to hide. Finally, our idolatrous worship of CI-CD (continuous integration, continuous development) ought to be re-thought. Do we overlook the “secure” in an SSDLC (secure software development cycle) because of market or business pressure? TTTA—continuous testing—is time consuming and expensive, but people will fly and hospitals may tend to the ill. #reliability #availability #integrity #security #quality
