This week, a deal was reached between Colorado state senators and the Oil and Gas Industry. The agreement is aimed at creating a compromise that will avoid dueling ballot measures in the November election. As a part of the agreement, the legislature will pass two bills: "one that will fund efforts to cap abandoned and low-producing wells to prevent them from leaking greenhouse gasses and set new emissions reductions targets in state law (and) one that will impose a new fee on every barrel of oil produced in Colorado that will fluctuate based on market prices but generate an estimated $138 million a year." A Trump-appointed judge in Louisiana approved a request from Republican-led states to lift the Biden administration's pause on new approvals for LNG exports. Industry-friendly leaders cheered the judge's decision while environmental groups expressed disappointment. Craig Segall, vice president of Evergreen Action, called the ruling “deeply misguided,” but said it would not stop the Biden administration from updating its criteria for new exports. According to data compiled in the Oil and Gas Watch database, plants already operating, under construction, or approved are capable of emitting at least 87.8 million tons of greenhouse gases every year, approximately equivalent to emissions from more than 17 million vehicles or more than 10 million homes. Allowing these plants to continue operating will result in the release of thousands of tons of smog-forming nitrogen oxides and volatile organic compounds each year. This will worsen local air quality and contribute to climate change. Cart before the horse or are we off to a strategic start? 🏇 However you choose to look at it, it’s impossible to miss the moves being made between policy and the oil and gas industry. The most recent news to hit the headlines for oil and gas involves none other than former President Donald Trump. Last Friday, media outlets flooded with news that big oil is writing executive orders addressed to Donald Trump, and positioning themselves early for a tide shift as we approach this Fall’s election. Rolling Stone reported that “The goal of the orders would be to roll back some of the Biden administration’s most progressive environmental regulations, such as halting natural gas export permits, slashing vehicle carbon emissions, and penalizing gas companies for methane leaks.” Dismantling some of the environmental regulations in place by the current administration will certainly ruffle feathers. The fine for a first “offence” could be up to $10 million, or three times the benefit gained from the “deception.” A second conviction would raise the fine to $15 million. These provisions probably violate the constitutional right to free speech and association under the Charter of Rights. But that would take years to establish in court. Meanwhile, companies will have to decide whether they will keep saying positive things about their climate change efforts, or simply fall silent. Silence is exactly what the drafters of these draconian measures want. Yesterday, the U.S. House of Representatives passed the Abandoned Wells, Remediation, Research and Development Act (AWRRDA) by a vote of 333 to 75. “Orphaned oil and gas wells threaten public health and safety, the water we drink, and the climate,” Adam Peltz of the Environmental Defense Fund said in a statement Tuesday. “This essential bipartisan bill will fund the research necessary to improve well plugging practices, find unregistered orphan wells in hard-to-reach places like streams, forests, farmland, and backyards, and develop beneficial clean energy uses for end-of-life wells.” In December 2023 at the Methane Mitigation Summit, we heard from the U.S. Department of the Interior on the Orphaned Wells Program, and it is great see to see further advancements on this. This marks the culmination of over a decade of advocacy by public health and environmental groups. The regulations will take effect on October 1, 2024. 𝑲𝒆𝒚 𝑷𝒐𝒊𝒏𝒕𝒔: The ban is a result of persistent advocacy by frontline communities and environmental organizations. The regulations aim to prioritize public health and environmental safety over oil company profits. A new health and safety law also prohibits new oil and gas permits within 3,200 feet of sensitive sites like homes and schools. The California Geologic Energy Management Division (CalGEM) is under scrutiny for lax enforcement of new laws and for rushing through well approvals.
