There are very few examples of what happens when a hunting ban gets put in place. We see them promulgated all the time - but do we have anything to really push back against it? i.e., do we have any proof? Often both sides of the argument simply only have words, they don't really show you the impact, nor have there been any circumstances that you can really point a finger at and say "See!?" Cabaneros National Park in Spain, and the hunting ban that has taken place there, is one of these points in time. As a professor in Spain noted "Cabaneros will be the example used to show what can happen when people are excluded from wildlife management!". My latest article delves into the use of the falconry exemption within section 6 of Schedule 1 of the Hunting Act 2004 with regards to the case of R v Adams appeal against conviction. Unreported, Cambridge Crown Court, 9 May 2019. We also explore the key distinguishing features between the Hunting Act 2004 and the Hunting with Dogs (Scotland) Act 2023 and how the Scottish legislation has concreted over the ability to the circumvent the law using the falconry exemption as a smokescreen for illegal hunting.
