6/6 It is well known within the world of commercial disputes that Hong Kong legal fees are somewhat higher than those of Singapore (for those seeking more rigorous justice) and well above those of mainland China (for those seeking to avoid protracted fights and who can live with "quick and dirty" justice). The headwinds now blowing against Hong Kong's commercial disputes market mean that the city's price premium might be more difficult to justify going forward. China's crackdown on dissent in Hong Kong might, at first glance, bear no relevance to Hong Kong as a commercial dispute hub. In fact, it has created a whole series of downstream impacts, including those arising from Collins' and Sumption's resignations, which risk putting Hong Kong's future in this area into doubt. Rather than engaging in empty positive talk, the Hong Kong authorities should take concrete measures to restore international commercial confidence in Hong Kong law, Hong Kong courts and Hong Kong arbitral venues. A significant agreement signed in 2019 between Mainland China and Hong Kong for reciprocal enforcement of judgments came into force on January 29, 2024, marking a significant milestone in judicial cooperation between Mainland China and Hong Kong. The Mainland Judgments in Civil and Commercial Matters (Reciprocal Enforcement) Ordinance broadens the scope of applicable judgments, including those related to intellectual property rights. This development allows for easier enforcement across borders without initiating new legal proceedings. Starting from January 29, 2024, any Mainland Judgment issued can be enforced in Hong Kong. Key points include coverage of various intellectual property rights and specified judgments, simplified enforcement procedures, and greater flexibility in choosing legal forums. Dear colleagues/lawyers from Kazakhstan, As we continue to strive for excellence and modernization in our legal system, I think it's important to ask ourselves: whether Kazakhstan should petition to join UNIDROIT and the CISG Convention?🤔 Why would we want to join UNIDROIT and the CISG Convention? We're all about making our laws as harmonized as possible! By joining UNIDROIT and the CISG Convention, Kazakhstan would be able to bring its commercial laws up to speed with international standards. This would make it easier for businesses to trade across borders, which would be great for the economy (I believe so). A unified legal framework would be a great way to show foreign investors that our country is a safe and welcoming place to do business. And, of course, we can't forget about dispute resolution. The CISG Convention is a great way to settle international commercial disputes. It helps to reduce the burden on our national courts and makes international trade fairer for everyone. We all want to know that the law is on our side. Joining these international bodies would be a great help to our businesses, giving them more legal certainty and reducing the risk of contractual disputes. I truly believe that joining these international instruments could be a huge benefit for our legal and business communities. So, I'm thinking of starting a petition on epetition.kz to get this moving! I’d love to hear your thoughts and insights on this matter. Do you support this initiative? MEMORANDUM OF STRATEGIC COOPERATION On October 1, CLS and the Pilot Free Trade Zone of Xiamen Area Administrative Committee of China (Fujian) entered into a Memorandum of Strategic Cooperation. The Pilot Free Trade Zone in China is a special territory where international economic and trade standards are tested. In Xiamen City, such a zone has existed since 2015 and includes 4 areas: government, financial, legal and human resources services. The Maritime Silk Road Central Legal District helps to strengthen commercial ties between China and the BRICS countries. The partnership with Xiamen Pilot Zone not only provides CLS with access to the BRICS trade integration platform, but also opens up opportunities for collaboration with Chinese clients.
