”Until We Reckon” by Danielle Sered was the best book I read this semester for Advanced Criminal Topics. The book discusses violence and mass incarceration. More specifically, Sered asserts that in order to mitigate violent crimes we need a culture shift in our glorification of violence for the purpose of policy change. The book got me thinking about what some call “the abuse excuse.” A phrase that minimizes the impact of child abuse on an individual’s reptilian brain (basal ganglia). The basal ganglia evolved to promote survival reflexes; it is responsible for motor learning/control, emotional and behavioral regulation—among other functions. So, the child who grows up in a violently abusive household will likely develop survival mechanisms different from their peers. An abused child might throw a punch they didn’t know lived within their capacity. “Until We Reckon” respects victims of crime and acknowledges the fact that survivors of violent offenses may endure lifelong mental and physical symptoms. Sered also notes that incarceration rarely gives families and victims/survivors the closure they need and deserve; she made the same note about state sponsored murder. The book advocates for restorative justice and provides many examples of families whose loved-one was murdered. With restorative justice, the offender: (1) acknowledges their crime and (2) witnesses the consequences of their violence on the victim. This had an eye-opening effect on the perpetrator, and the offender’s actions of accountability provided closure for several families. The main idea: prison is a violent place for retribution rather than rehabilitation, and often provides little closure for families and victims of crime. In contrast, restorative justice promotes closure for victims and their families while forcing the offender to (1) acknowledge the consequences of their violence, (2) recognize the consequence(s) of their crime, and (3) take measures of accountability for both their crime. The offender also has an opportunity to rehabilitate in a non-violent setting and learn tools for rehabilitation. A shocking percentage of incarcerated individuals experienced violent physical and/or sexual abuse as children. If we, as a society, can change our culture of violence then mitigation of violent crime and mass incarceration is possible. #childabusepreventionmonth #criminallaw #lawschool
