𝟭𝟬 𝘁𝗵𝗶𝗻𝗴𝘀 𝘆𝗼𝘂 𝗻𝗲𝗲𝗱 𝘁𝗼 𝗸𝗻𝗼𝘄 𝗮𝗯𝗼𝘂𝘁 𝗨𝗦 𝗹𝗶𝘁𝗶𝗴𝗮𝘁𝗶𝗼𝗻 - #𝟮 𝗗𝗶𝘀𝗰𝗼𝘃𝗲𝗿𝘆 Foreign lawyers often associate US discovery with the production of 🚚 loads of documents and with 🎣 expeditions. There is however more to it than that. The first thing to note is that the US takes a (very) different approach to the collection of pre-trial evidence than most other countries. In civil law countries, the general rule is that a party must prove its case with the evidence at its disposal. And it will lose its case when it fails to do so. The possibility to obtain documents from the other side is generally limited to documents that are known to the requesting party and are relevant for the outcome of the dispute. This is a practice that is often followed in international arbitration cases as well. In the US, the purpose of discovery is to seek the truth and to decide disputes on what the facts reveal, not on what is being concealed. Parties are therefore expected to share information and evidence with the other side. Discovery gives parties the opportunity to find out about the strengths and weaknesses of the other parties' case pre-trial. Discovery can therefore help parties to reach a settlement. It also aims to prevent "trial by ambush", where one side doesn’t learn of the other side’s evidence or witnesses until the trial. The scope of discovery is broad: it may be obtained about any matter relevant to the subject matter of the case. The other thing that makes US discovery unique is that it is much more than document production. Discovery includes: 𝗗𝗲𝗽𝗼𝘀𝗶𝘁𝗶𝗼𝗻𝘀 – this is one of the most common methods of discovery and is about getting an out-of-court statement given under oath by any person involved in the case. 𝗜𝗻𝘁𝗲𝗿𝗿𝗼𝗴𝗮𝘁𝗼𝗿𝗶𝗲𝘀 – these are written questions that one party asks another party to answer under oath. These questions must be specific and relevant to the case. 𝗔𝗱𝗺𝗶𝘀𝘀𝗶𝗼𝗻𝘀 - these are written requests to the other party to admit or deny specific facts related to the case. Discovery also includes requests for 𝗶𝗻𝘀𝗽𝗲𝗰𝘁𝗶𝗼𝗻, 𝗲𝗻𝘁𝗿𝘆, 𝗺𝗲𝗻𝘁𝗮𝗹 𝗼𝗿 𝗽𝗵𝘆𝘀𝗶𝗰𝗮𝗹 𝗲𝘅𝗮𝗺𝗶𝗻𝗮𝘁𝗶𝗼𝗻𝘀 and, of course, 𝗱𝗼𝗰𝘂𝗺𝗲𝗻𝘁 𝗽𝗿𝗼𝗱𝘂𝗰𝘁𝗶𝗼𝗻. The discovery phase can be quite a lengthy process. And a contentious one, if a party does not comply with discovery requests. If that happens and parties are not able to resolve the issue themselves, the court will be asked to take decisions. One of the possible results of discovery is that a party finds that there is no real dispute about material facts and that a trial is not necessary to present evidence in court. The party may then move for a summary judgment motion.
