We are updating discount rate calculation with a risk premium and the calculation of patent score. 📆 𝐓𝐮𝐞𝐬𝐝𝐚𝐲: >> I attended the SIBB Startups workshop "𝐁𝐮𝐬𝐢𝐧𝐞𝐬𝐬 𝐀𝐧𝐠𝐞𝐥𝐬 𝐅𝐮𝐧𝐝𝐢𝐧𝐠" given by Sebastian Schwenke from Business Angels Club Berlin-Brandenburg e.V. The contents of the IP reports include scanning all existing and possible IP rights of the startups and detailed analysis of the patentability of their invention, including patent filing strategy and cost estimation. 📆 𝐓𝐡𝐮𝐫𝐬𝐝𝐚𝐲: >> I attended our weekly early morning meeting with Sabancı University Nanotechnology Research & Application Center to discuss patent commercialization activities. >> Came to Izmir/Turkey for family visits and for the General Assembly of LES Turkey which will be held in Istanbul on April 15th. 📆 𝐅𝐫𝐢𝐝𝐚𝐲: >> Today, I am focusing on the patent valuation calculation process for our Patentiv platform. Setting up new assessment tools for inventions and patent maturity analysis to understand readiness for valuation. >> I will be sending out the issue #77 of our Patent Insights newsletter to our patent-lover susbscribers. U.S. universities issued almost 8,800 new patent licenses or options in 2021. Increasingly, university technology licenses or license options are executed by startups and small firms (those with fewer than 500 employees). In 2011, startups and small businesses accounted for 69% of new licenses or options—by 2021, this portion had increased to 78%. Most university-related startups are in the home state of the research university (66%). The number of university-related startups launched annually increased steadily through 2017 and reached a peak of 1,125 in 2020 before declining slightly in 2021.

Are patents always an asset for startups? The answer is that it depends (as always in the field of innovation!) A patent is useful as long as it allows you to do something and exclude others to do the same. How the patent is written therefore can determine how strong it will be. If patents didn't have to be novel . . . . . . someone else could copy and patent your product. It turns out the patent novelty rule provides really important protection for startups. Novelty law can be leveraged to: → Block others → Differentiate your product → Save your ability to get a patent Plus, it keeps our patent system honest—we want to make sure that people aren't just recycling old patents. Innovation and patents are locked in a complex dance Innovation is the lifeblood of progress. It's the spark that ignites new ideas, propels technological advancements, and shapes a better future. But how do we incentivize this creativity? Patents act as a reward system. By granting inventors a temporary monopoly on their creations, patents provide them with the financial security to recoup investment costs and potentially generate profit. This financial incentive encourages inventors to pour time and resources into research and development (R&D), ultimately leading to a greater volume of innovations. While patents offer undeniable benefits, a well-functioning system is crucial to ensure they continue to fuel progress, not hinder it. By fostering collaboration, transparency, and competition, we can leverage the power of patents to create a brighter future for all. Globally innovation focus reaches new highs, as per Nasscom’s report Globally IP creation is gaining prominence with 3.46 million patents filed in 2022 compared to 3.4 million in 2021 The patent filing landscape in India is booming! Here's a breakdown of the positive outlook: Growth Trajectory: India has witnessed a remarkable surge in patent filings, with a record-breaking 24.6% increase in FY2023. India’s share increased to 2.2% from 1.8% during the same period. Computer technology continues to maintain its top position among all application areas, doubling its share over the last decade. Share of women patent filers globally grew from 16.5% in 2021 to 17.1% in 2022. India recorded an increase from 10.2% in 2021 to 11.6% in 2022. Domestic Drive: The trend of Indian residents filing more patents is encouraging. In FY2023, over 50% of applications originated from domestic entities, reflecting a growing awareness of intellectual property (IP) rights. Evolving Landscape: Other interesting trends include a rise in filings by women inventors (reaching 11.6% in FY2022) and a surge in applications from Tamil Nadu, currently the leading state in patent filing. While the outlook is bright, some challenges remain: Balancing Exclusivity and Competition: Ensuring patents incentivize innovation without hindering competition through excessive exclusivity is crucial. Streamlining Processes: Simplifying and expediting the patent application process can benefit smaller inventors. Overall, India's patent filing scene is experiencing a surge of activity, driven by domestic innovation and a focus on technology. 💡 Biotech Basics 💡 This week we are going to touch on the challenges following that famous lightbulb moment in honour of the first 2024 Activator Seminar - a masterclass on IP Strategy and Confidentiality delivered by Venner Shipley. Valuing a startup idea requires an honest and in-depth assessment of the commercial potential of your research. The first step in this process involves a freedom-to-operate (FTO) search to determine whether your idea would infringe any existing patents. Then you may need to file for a patent to ensure that you are not blocked by others. An issued patent provides more substantial protection. You should also assess the potential market need and size for your product to justify its overall value and attract investors. The usual place to start the FTO search and market analysis is your institution's Technology Transfer Office (TTO). The TTO can help with these evaluations and allow a confidential discussion about whether a viable new company opportunity may exist. If your institution does not have an experienced TTO, you can outsource the IP assessment to a reputable IP law firm, with prices ranging from £4,000 to £30,000 or more. For the market assessment, you can start with the internet or get help from business school students or consulting groups that can research the field for a fee. After the assessment of FTO and market opportunity, the TTO might not agree that your idea merits IP protection and that the opportunity is suitable for a startup. But if the FTO search and potential market opportunity are encouraging, that creates the initial momentum for forming a NewCo. To proceed with startup company creation, subsequent questions arise, such as how to fund the company, who should be involved, and how to manage IP rights. These questions can be answered concurrently or in any order, depending on the resources available and the stage of the technology. A business plan is essential to guide the startup process and attract potential investors. In summary, valuing a startup idea requires an assessment of the commercial potential, FTO search, and IP assessment. The TTO is a usual place to start the evaluation, but outsourcing the IP assessment to an IP law firm or consulting group is an option. If the FTO search and potential market opportunity are encouraging, that creates the initial momentum for forming a NewCo. Subsequent questions arise, and a business plan is essential to guide the startup process and attract potential investors. This is a complex process, but we are here to help!
