Cormac Cullinan’s remarks here are very astute indeed! When evaluating the normative foundations of environmental law, a paradigm shift in the way that we conceptualise the natural world is required. The law must recognise that all living beings have rights, both intrinsic ones which relate to their experiences (traditionally “animal rights”, but arguably this extends to plant life as well) and extrinsic ones that pertain to the ecological infrastructure within which they live and operate (“the rights of nature”: this includes the rights not to have their habitats and ecosystems excessively damaged—Global Alliance for the Rights of Nature (GARN)). Until we reformulate the underlying legal and ethical principles that appertain to nature, we will continue to unfairly and disproportionately prejudice one species (us) at the expense of the broader Earth system.
