A lack of policyholder attendance at trial can be a real issue for a successful low speed impact defence - but it isn’t always terminal to the defence! We had a superb result at trial this week where our client’s insured simply couldn’t attend the trial despite assisting with the defence throughout as it was not proportionate to seek an adjournment. We had dashcam footage of the incident and so decided we would run to trial without the witness giving oral evidence. At trial the court saw the minor contact and claimant’s vehicle (a lorry carrying a loaded skip!) continuing until they were flashed to stop. This is despite the claimant claiming in his statement and medical report that he was “thrown forwards, then backwards, then right and then backwards again”. A DPA response from the claimants insurer also confirmed that it was reported that the “driver was unaware of any collision”. The claimant challenged the authenticity of the DPA response but the court, quite rightly, found that the account must have come from the driver as there was no one else that could have given it. The judge found the claimant to be entirely unimpressive and tailored evidence to suit under questioning. Ultimately the claim was dismissed in full with the claimant being found to be fundamentally dishonest. The claimant now owes costs of over £5990! Just shows, that with the right evidence, certain obstacles within litigation can be overcome.
