Law students and attorneys should listen to oral arguments. Only a small percentage of cases a heard by the Texas Supreme Court. Not all of those cases are granted oral argument. These tend to be interesting cases with superior attorneys.

Texas medical malpractice attorneys- new Chapter 74 case ruling. The TX Supreme Court found that plaintiffs' expert reports sufficiently addressed breach of the standard of care, causation, and were not conclusory. This continues the Court's hostility towards challenging Chapter 74 reports. The trend is very much demonstrated at the Appellate level, with few defendants winning appeals by arguing the expert report is insufficient. While the appeal remains an effective delay tactic, healthcare institutions and providers should generally save the money and hold off on these appeals.

On December 3, 2024, enforcement of the CTA was enjoined by a preliminary injunction issued by the U.S. District Court for the Eastern District of Texas. However, on December 23, 2024, the United States Court of Appeals for the Fifth Circuit issued a stay on that preliminary injunction. After this most recent decision, the reporting requirements (“BOI Reports”) are back in place, but with delayed reporting deadlines.
