The Accountability Framework initiative (AFi) has released its updated Common Methodology with standardized metrics to assess corporate efforts to eliminate deforestation and human rights abuses from commodity supply chains. Designed for use by initiatives and organizations, the updated methodology reflects the learnings of disclosure and assessment organizations over the past five years and enhances comparability and value in assessing corporate performance. 🇪🇺 Today marks an important milestone as the Corporate Sustainability Due Diligence Directive (#CSDDD) officially enters into force. Member states have 2 years to transpose the text into national law and in 3 years the requirements will apply to the first group of large companies. This landmark legislation is an important step in advancing human rights due diligence and promoting sustainable business practices by emphasizing the identification, prevention and remediation of sustainability risks. What a nice way to spend a Tuesday morning! St Ethelburga's Centre for Reconciliation and Peace provided a stunning backdrop to this morning's LIDW event on the role of General Counsel in managing global ESG risks. It was a real pleasure to join the team from Ankura, Charles Russell Speechlys, McLarty Associates, and we covered a lot in our two panels! Key takeaways: 🌍 We discussed the geopolitical and regulatory developments driving mandatory #ESGDD and the new way of thinking about due diligence that is needed... 🔎 The scrutiny of increasingly complex upstream supply chains that are called for by #CSDDD and other regs means 'front-loaded' transactional due diligence is no longer adequate (if it ever was!). 🤝 A shift is needed to view DD as an ongoing activity, with a focus on building relationships with suppliers and supply chain partners, because... ...codes of conduct don't stop environmental and human rights impacts and current ethics whistleblowing lines aren't adequate for providing the grievance mechanisms needed to reach impacted rights holders. 📋 The long-maligned supplier audit still has a role, but capacity building is fast becoming the preferred tool for addressing risk root causes and achieving long-term risk reduction. The CSDDD brings another perspective to the EU Green Deal context, as it will have a relevant impact across global supply chains. The good news is that, since 2011, human rights practitioners have been implementing the UNGPs and a lot of good practices are well known. Not to mention the practices around responsible sourcing which have largely developed across certain sectors. At ERM we have been closely monitoring the directive developments.
