Appraisal time 🩺 Morning meeting with my appraiser. Going through my last 12 months medical practice Understanding the options if I wish to remain on the register even though I’ve retired from medicine. Less than 20 days work (40 sessions) in the next 12 months puts me on the ‘low volume register’ and means a lot of scrutiny. More than 20 days and it should just be appraisal as normal. After more than 20 years as a doctor it feels REALLY comfortable doing that job and knowing it is there as a safety net. But I stopped thinking of myself as a doctor about 3 years ago, so is it time to draw a line under it? 🤔 What would you do? Expert Witnesses must provide adequate reasoning Expertise alone isn’t enough to ensure your opinions hold weight in court. In Nguyen v Northern Sydney Local Health District [2024] NSWSC 1299, a key expert report was ruled inadmissible because it failed to provide adequate reasoning behind its conclusions. The court cited the importance of following the standards set by Makita (Australia) Pty Limited v Sprowles, which requires that experts clearly explain how their specialised knowledge applies to the facts of the case. One of the major takeaways is that expert opinions must be grounded in transparent, well-reasoned explanations. In this case, the expert's projected sales figures and the discount rate used in a valuation report were heavily criticised for lacking clear justification. Merely stating an opinion without explaining the reasoning behind it undermines the credibility of the expert’s testimony and risks exclusion from evidence. Additionally, when working with information provided by others, it’s crucial to either independently verify the data or explain why it can be relied upon. In Nguyen, the expert adopted figures from the commissioning party without demonstrating how they were reached or why they were appropriate. This reliance on unsubstantiated data weakened the entire report, illustrating the importance of independent analysis in expert testimony. For any expert witness, the lesson here is clear: providing clear, logical reasoning is just as important as your qualifications. Courts are looking for more than just conclusions—they need to see how you arrived at them. CA QMEs, be careful what kinds of reports you agree to produce. This story had a happy ending, but it could've gone the other way.
