The latest package of sanctions announced by the European Union will require EU-based companies to add a contractual clause preventing the re-export of aviation equipment and related services to Russia. Article 12g, or the “no re-export to Russia” clause, within the European Union’s latest package of sanctions against Russia released in March, aims to prevent the forward sale, transfer and export of goods and services from a third-country counterparty to Russian entities. “The new clause effectively aims to target any potential backdoors or loopholes around current EU sanctions”, explains Bird & Bird legal director Hannah Moran-Ellis. A ceasefire between Russia and #Ukraine in 2024 is unlikely, compelling Western governments to expand #sanctions to further constrain Russia's war funding. The EU approved its 13th sanctions package against #Russia this week. Some members, such as #Lithuania, urged #Brussels to target sectors rather than individuals in its 14th package. Multinational companies will face increasing exposure to sanctions throughout 2024, including secondary sanctions and in countries like #India and #China. Rising exposure to sanctions will increase due diligence costs for businesses.
