As such, we support the recommendations of the Domestic, Family and Sexual Violence Commission’s Yearly Report to Parliament, including the recommendation of a move to funding models that provide more certainty through longer funding periods. Specialist early intervention and crisis response legal services like the Domestic Violence Unit are critical to achieving enduring safe and positive outcomes for victim-survivors of gender-based violence.
Legal help plays such an important role in addressing the domestic violence crisis in NSW. The DVU and our staff at Legal Aid NSW provide critical legal help to women who are experiencing violence or who live in fear of violence. We are also able to provide support and assistance to women experiencing other problems including with debt, housing and homelessness, and immigration. https://lnkd.in/gZ2NWRVy

“The system is in a precarious state and ultimately the ones who will suffer are those trying to seek justice." This is Nick Emmerson speaking out on the news that changes to the legal aid means test have been delayed until 2026. The legal aid means test (which determines someone's eligibility for legal aid) has not been updated in line with inflation since 2009. Since then, prices have risen by 40%. This means fewer people are eligible for legal aid each year and may be unable to access justice. Research by the The Law Society shows that people on incomes below the minimum standard are being excluded from legal aid, meaning families living below the poverty line are failing to meet the extremely restrictive thresholds to get legal aid. Another barrier to getting justice is the value of people’s home being taken into account in the means test assessment, even though they cannot access this money. Civil legal aid providers are questioning their ability to stay in the profession with 40% of providers telling the government that they will actively leave the sector. We see first-hand the challenges that domestic abuse victims-survivors face in accessing legal aid to help them to secure a civil protection order. In a landmark decision that echoes the wisdom of Solomon in a modern context, the Supreme Court of Appeal (SCA) of South Africa recently navigated the complex terrain of international child abduction in the case of C.A.R v Central Authority (737/2023) [2024] ZASCA 103 (21 June 2024). This case, which involved the application of the Hague Convention on the Civil Aspects of International Child Abduction, highlights the delicate balance between upholding international legal obligations and safeguarding the best interests of the child. The court's nuanced approach in interpreting the "grave risk" exception under Article 13(b) of the Hague Convention underscores the challenges faced by judicial systems worldwide in an era of increasingly globalised families and cross-border disputes. The SCA's ruling not only reaffirmed the fundamental principles underpinning the Hague Convention but also provided critical guidance on the role of the Central Authority and the evidentiary standards required to invoke the "grave risk" exception.
