Charities, and the law that governs them, shape how we can make a positive impact in our communities. If you are involved with a charity, you should be aware of recent changes to the Charities Act; with more on the way. The Charities Act 2005 is the key legislation controlling how charities operate in New Zealand. The amendments include a broadened definition of an officer (capturing more people subject to duties), mandatory governance reviews every three years, and scope for disqualifying individuals for serious wrongdoing without deregistering the entire charity. Starting 5 July 2024, a more accessible appeals process will be introduced, allowing appeals relating to charitable status to the Taxation Review Authority before the High Court, with extended time for lodging appeals and the option for self-representation.
