Machinery Guarding Is your machinery guarding compliant to regulation 208 of the Western Australian Work Health and Safety (General or Mines) Regulations? Failure to comply with the regulation can result in a fine of $7,000 for and individual or $35,000 for a company. If you are unsure if your machinery or plant guarding is compliant, why not have Safety Resources Australia undertake a guarding assessment of your workplace plant. I totally agree with the comments below. PUWER assessments are a legal responsibility of the end user and can prevent the heartache of dealing with accidents. One area where this is important is at the interface between 2 machines from different suppliers, hazards often exist at the junction between these machines and can only be picked up when the PUWER risk assessment is done as they cannot always be identified at acceptance trials.
Martin’s Monday Machinery Myth Part 5 “If we buy a brand new machine and one of our operators gets injured because the manufacturer didn’t guard it properly, it’s not our fault - it’ll be the manufacturer that gets prosecuted.” They might, but it’s very unlikely. Prosecutions of machinery manufacturers under either section 6 of the Health & Safety at Work Act or under the Supply of Machinery (Safety) Regulations do happen, but in practice they are proportionately very rare compared to prosecutions of end users under PUWER. In this scenario it’s very likely that if any enforcement action is taken, it will against the end user company whose staff are operating the equipment. Employers are required under Regulation 6 of PUWER to inspect equipment after installation but before it is first used. The inspection has to be carried out by someone competent i.e. a person with the skills and knowledge to be able to spot issues such as additional guarding being required, and whether, in fact, the machine actually complies with the Supply of Machinery (Safety) Regulations.
