Oral arguments took place yesterday in Peridot Tree v. Sacramento. The 9th Circuit Court of Appeals sounds ready to tell the District Court that it cannot abstain from deciding the question whether residence requirements built into the City of Sacramento's social equity program violate the dormant Commerce Clause (DCC) under the US Constitution. District Courts within the 9th Circuit have increasingly been abstaining from deciding cases like this one, though, as the Court noted, doing so without being able to identify a recognized abstention doctrine neatly applicable to this context. The panel seemed to suggest that the case is directly analogous to the 1st Circuit's decision in Northeast Patients Group v. United Cannabis Patients & Caregivers from last year, which held that prohibiting out-of-state ownership in state-licensed cannabis businesses violates the DCC. Peridot Tree is also a case being watched closely by those of us interested in the DCC as a potential path towards unlocking interstate commerce in cannabis. Nonetheless, in my view, challenges to residency requirements in the context of thoughtfully-constructed social equity programs exist on different footing than challenges related to prohibitions on interstate sales and/or restrictions of out-of-state ownership outside of the equity context. Social equity programs are, as relevant here, express attempts by state and local governments to remedy their own historical wrongdoing in implementation of the War on Drugs. Tailoring such programs to benefit those who were, in fact, directly impacted by such wrongdoing is narrowly tailored and rational in ways that are simply not true with the other cases. Given California's clear interest in implementing both social equity programs and interstate commerce, cities defending these challenges need to get more adept at calling out this distinction. Today, the NYS Register published the amendments to the Rent Stabilization Code, NYS Tenant Protection Regulations and the NYS & NYC Rent Control Regulations. These amendments are effective as of today, November 8, 2023. While the “Purpose” of these amendments as indicated in the Notice of Adoption is, “[t]o implement the changes required or informed by the Housing Stability and Tenant Protection Act of 2019,” we believe that several amendments are unsupported by the HSTPA (thus making them subject to legal challenges). We anticipate that DHCR will now begin the process of modifying the Agency’s Fact Sheets and Operational Bulletins to reflect these amendments. The interpretation and application of these amendments will be an evolving process.

Cannabis Real Estate: Land Use / Planning and Zoning is a critical aspect of getting a cannabis business open that most have never had to manage. A few tips: 1. Hire a local land use attorney. Your regular lawyer has no business trying to convince a local planning board that the application is a good one. Make sure the person you have has both appeared before that board and has been successful. 2. You will need way more time and money than you think to get through planning approval. It can take months just to gather what you need, let alone review periods and dealing with public notice and meeting schedules. 3. Site plans - it can take even the best engineer or architect over a month to get a land survey or certified plans completed. Plan early and if possible get a survey from the land owner during your diligence period. 4. Traffic Studies - not unique to cannabis but seemingly required for almost every application I’ve done. This can take 3-4 weeks and cost upwards of $10,000. It can also make or break your application depending on parking requirements and the board’s satisfaction with the impact all the traffic will have on the area around your store. 5. Find parking solutions nearby for employees if possible. This helps with number 4. 6. Be prepared for th city to gate keep by making you pay for things like crosswalks, curbing changes, etc. it’s a shitty reality, but the local people know how competitive these licenses and normally try to extract concessions to improve the area. A Pennsylvania appeals court has just stricken a judgment that had been entered against an indoor cannabis cultivator, finding that the landlord had sought an improper "double recovery." Under Pennsylvania law, a landlord of a tenant who is in default must decide whether they want (i) to take possession of the property before the end of the lease, or (ii) to recover (i.e., "accelerate") all future rents that would be due through the end of the lease. The landlord may not do both.
