EUDR Delay update 🇪🇺 (and important US link with Trump in office 🇺🇸 ): The European Parliament just adopted the request for a delay of 1 year and amendments 3, 4, 5, 6, 7, 9, 10, 11. (See link in comments) Important adopted amendment: inclusion of a "No Risk" country category for which no DD is required & authorities need to audit 0,1% of imports from these countries. ‘No Risk’ refers to countries or parts thereof that meet the following assessment criteria: - Forest area development remained stable or increased compared to 1990; - Paris Climate Agreement and international conventions on human rights and preventing deforestation are signed by countries and parts there of; - Enforced regulations on preventing deforestation and forest conservation at national level are strictly implemented in full transparency and monitored 🇺🇸 The second point is significant because the US has rejoined the Paris Climate Agreement, which Trump withdrew from during his first term. And he is planning to do so again. 🇪🇺 The new “no-risk” category will potentially exempt all EU countries from due diligence requirements. It is understandable that organisations will not want to see changes to the EUDR regulation that amount to moving of the goal posts, however, there are several specific technical areas that at least require further clarification beyond the recent guidance details issued by the DG for Environment: https://lnkd.in/eQaPAYnK Just one example is the proposed idea that companies can "use any maps that they see fit for the purpose of their due diligence exercise or checks". (page 33 of the October 2nd guidance document). Following this approach will undoubtedly lead to confusion and dubeity regarding the compliance of products. Different maps show different areas of forest extent and some production areas may be shown as within areas classified as forest on some maps but on agricultural land in other maps. Global maps never or rarely capture sufficient detail to provide definitive classifications at the scale defined within EUDR. Notable areas of potential confusion (differences in classification) are areas under agroforestry systems such as shaded cocoa and coffee. These areas are often the managed / owned by smallholders and communities, including indigenous groups that the EUDR seeks to protect. Several countries / regions such as Ghana, Mexico and parts of Nigeria have made significant advances in land use classification to provide definitive sources for the purposes of EUDR and national land use policies. Where these products are available and shown to be of suitable quality they should be used as the authoritative information source to avoid confusion and the potential exclusion of large numbers of producers from the EU market. There are several other technical issues that are likely to combine against the interests of small farmers, communities and indigenous groups as this regulation comes into operation. The FTAO remains firmly behind the implementation of this unique legislation as one of the most precious remnants of the #EuropeanGreenDeal. However, the success of the initiative depends on smallholders having the necessary financial support to meet its strict requirements. The momentum generated by various actors preparing for EUDR implementation must be capitalised on.
