Dear Connections, I am thrilled to announce that Khurana & Khurana has published my blog titled "Sub-Classification within Scheduled Castes -A New Dawn for Social Justice?" Thank you so much to the Khurana & Khurana team for your support. The issue of sub-classification addresses whether the government should create further categories within the SCs to ensure that the most disadvantaged groups receive their fair share of benefits, such as reservations in education and employment. The debate has seen differing opinions, with some arguing that sub-classification could enhance social justice by targeting benefits more effectively, while others believe it could lead to further division and undermine the unity of SCs. Recent judicial decisions and legislative actions are crucial in this context, as they could reshape how affirmative action policies are implemented in India. This blog likely discusses key legal precedents, the reasoning behind sub-classification, and its potential impact on the future of social justice in India. kindly, check it out : - https://lnkd.in/gXyjmanu #socialjustice #legalreforms #indianlaws #devindersingvsstateofpunjab #supremecourt

Exclusion of the creamy layer from the Scheduled Castes and Scheduled Tribes "The question that will have to be posed is, whether equal treatment to unequals in the category of Scheduled Castes would advance the constitutional objective of equality or would thwart it? Can a child of IAS/IPS or Civil Service Officers be equated with a child of a disadvantaged member belonging to Scheduled Castes, studying in a Gram Panchayat/Zilla Parishad school in a village?" Justice B.R. Gavai "The reservation, if any, has to be limited only for the first generation or one generation and if any generation in the family has taken advantage of the reservation and have achieved higher status, the benefit of reservation would not be logically available to the second generation." Justice Pankaj Mithal A seven-judge constitution bench headed by Chief Justice D Y Chandrachud held by a 6:1 majority that the principles of social equality would entitle the State to provide preferential treatment to the most backward classes among the scheduled castes. #reservations #schedulecaste #scheduletribe #education #upsc

Human (Child) Rights I Public Policy I Legislative and Judicial Advocacy | Local Self Governance | Institution Building I Sustainable Livelihoods I Risk Informed and Human-Centric Program Design.
Revisiting the importance of #institutions in achieving #sustainabledevelopment. An #inclusive and #empowering institution is the right response to address #inequality and act as a connector between the community and the governance system. Evidence shows that institution of plays vital role in human civilisation, and #answer to minimise the resource gaps and accelerate the process of #social change. In India, #traditional institutions, whether family-based, community-oriented, religious, academic, or governance structures, often demonstrate advanced inclusivity and robustness compared to #modern institutions based on external principles borrowed from elsewhere and not relevant in the local context. The effectiveness and efficiency of institutions are closely tied to the #ownership and stake that people have in them. Greater stake leads to a more profound #impact. It is necessary to assess the impact of various forms of institutions, particularly #traditional, vs #modern; and their effectiveness in the societal transformation process. For example, both #marriage and #family, as institutions at the lowest level, are at stake due to various factors. The ideas of #equity and #euality as articulated modern schooling system, and with increased disposable income, and the influence of individuals (role model) or institutions, negatively impact the existence of the core institutions, leading to increased trends of unnecessary or forced family separation. This trend has adversely affected the #rights of children to live in a family or family-like environment(except natural cause), as well as their right to live with dignity and have an identity. A similar challenge is observed in the schooling system, where formal #education is provided with a curriculum that is not owned by the community, out of context, and is largely based on the theory of change based on the advanced management control systems, undermining the concept of people’s participation and ownership in school management. Let’s not ignore the power of #knowledge transformation from one generation to next by #indigenous communities through oral form since ages. The growth story of #Self-governance institutions faces equal challenges in terms of people’s participation and ownership, with numerous guidelines and standard operating procedures dictating basic functioning. Another example is the #caste panchayat, which acts as a guardian of a particular caste group to preserve cultural identity. However, these institutions are often portrayed negatively in public domain, despite representing positive #social norms. It is important to note that the caste hierarchy exists in all faiths. In conclusion, it is vital to #reflect inward, take efforts to bridge #capacity gaps, and enhance institutions to increase the efficiency, rather than borrowing irrelevant ideas from elsewhere and creating parallel, ad-hoc institutions based on funding arrangement that undermine the power of the people.

White Paper Proposal: Revocation of Caste Titles from Individual Surnames to Combat Discrimination Submitted by: All India Sustainable Development Council (AISDC) Submission to: United Nations Initiative on Social Justice and Equality Executive Summary: This white paper seeks to propose a global initiative under the auspices of the United Nations (UN) to revoke the use of caste-based titles in individual surnames. The initiative aims to combat caste-based discrimination, particularly in India and other South Asian countries where caste has historically been a source of systemic inequality and social exclusion. The proposal addresses the urgent need for action to eliminate the embedded social biases perpetuated by caste identifiers in names, which continue to negatively impact access to education, employment, and social mobility.

Amid the celebrations of board exams successes, the race to the finish line of marks and the crossroads of the future ahead, a few pertinent questions are worth a thought. Are our students involved in matters that matter? Is our #education system raising them to be individuals responsible for towards the wellness of the society? Do schools and homes build spaces that are conducive to open minded discussions and debates? Are we raising a generation that feels discomforted with injustice? Or are we adding to the social disparities by raising youth who are blissfully ignorant and happy in their digital comfort zones? #Chetan #Bhagat poses some serious questions here!
