Q1: What are the key elements of a binding contract in Malaysia? To form a legally binding contract in Malaysia, the following key elements must be present: 1. Offer: A clear and definite statement of terms by one party. 2. Acceptance: Clear agreement to the terms of the offer. 3. Consideration: Something of value exchanged between the parties (e.g., money, goods, services). 4. Intention to Create Legal Relations: Both parties must intend to enter a binding legal agreement. Without these elements, a contract may not be valid or enforceable.

I have found the OAP document useful as a SENDCO tool. It can be a helpful reference point for teachers when considering provision for children. I think there is more potential, particularly in supporting parents trying to navigate the SEND systems. Like many things, it's down to interpretation and motive. It can be used for good, or not!
