FAMILY LAW Hon Lady Justice Celia Nagawa, while emphasizing that the basic concern in matters of child custody should always be the best interest of the child, stated that, court cannot conclude that a parent’s past absence from a child’s life should automatically disqualify them from future efforts to assume their parental responsibilities. To impose such a restriction would not only unfairly penalize the parent but, most importantly, would harm the child by depriving them of the opportunity to build a meaningful relationship with that parent. The primary focus must always be in the best interests of the child, which includes the potential for positive involvement from both parents, regardless of previous circumstances. In some cases, the court can extend parental responsibility beyond a child's eighteenth birthday if there are special circumstances. Some of these circumstances include; Special needs or disabilities, Ongoing education or support, Emotional or psychological struggles. Where the court agrees that these circumstances exist, it can then grant a parental responsibility extension to ensure the child's well-being. My child turned 18. Can I stop paying child support? No. The obligation to pay child support does not automatically terminate when a child turns 18 years of age. In New Jersey, an obligation to pay child support only terminates when a child is emancipated. Our courts deem a child emancipated when they move “beyond the sphere of parental influence.” Whether a child is beyond the sphere of parental influence is an extremely fact sensitive determination. For example, children who continue their education on a full-time basis after high school remain unemancipated. Courts will also take into consideration any special needs or circumstances that a child may have that may impact their ability to achieve an independent status. 🤩 Important! Prenuptial Agreement Provisions About Children 🤩 (📧 Subject line of an email from a NY family law litigator colleague who was “phoning a friend” for input at the last possible and very unnecessarily stressful moment in their process! ⏱️) ⚠️ Here’s the crux of what I hope turned out to be helpful in my reply: 1️⃣ Custody and Visitation ⏩ Not binding, can be modified by the court. 2️⃣ Child Support ⏩Must meet state guidelines, subject to court approval. 3️⃣ Parental Rights ⏩Determined by state laws, cannot be waived or altered. 🎯 My two cents were specific to the attached sample prenup they sent me and one particular provision related to children, where the possible future parents express their aspirational goal of joint legal custody, but state it as if there were no uncertainty. That’s a no-no! ⛔️ Art. 11 in the attached is a great example of a conversation that has to be had and understood. It’s an attempt at an unenforceable provision for joint legal custody of a child, a child you don’t have yet, and it won’t prevent a judge in the future from doing what it takes to protect a child, and further their best interests through future orders that take into account future circumstances. ⚖️ 🧑🧑🧒 Common sense I guess. But worth noting because people often wonder what if anything they can put into these agreements about children at the time they sign the prenup. ☎️ Stay informed and ensure your prenuptial agreement is solid…don’t hesitate to phone a friend! ACTUAL CUSTODY VERSUS LEGAL CUSTODY Actual custody is the physical possession, care and control over a child which in simple terms means that either parents can be present in the child's life taking care of basic needs including education. In most cases, parents live separately hence co-parenting in today's world. Legal custody on the other hand, is the conferment of parental rights and responsibilities over his/her child for a definite period of time. Legal custody is granted by a Court when a child maintenance case is filed by either parents. Legal custody can be granted to sole or both parents. This will depend on the circumstances the parents live in and the best interests of the child which overrides every other interest regardless of the parents' wishes. #legal #custody.
