The Good: The DOE has released proposed rules aimed at fast-tracking the development of high-voltage electric transmission facilities, something everyone I talk to thinks is a critically important goal! The Bad: While the proposed rules promise efficiency, my partners--some of the smartest, most deeply knowledgeable folks in energy infrastructure development and regulation--are concerned the actual effect of the rules as drafted may be to extend review timelines, increase litigation risks, and, notably, still neglect key state-level challenges to siting transmission infrastructure. The Ugly: The proposed rule is expected to bring a deluge of comments due to the critical intersection of environmental policy and infrastructure development that it seeks to address.
