For 3Ls looking for jobs, do not put all your eggs in the Austin basket. It’s unfortunate that some lawyers I have opposed (including several City of Toronto #employmentlaw litigators) have been unable to apply these important skills in their practice. law is not about bullying and menacing opposing parties into defeat. The second litigation becomes personal for lawyers is the second a tremendous disservice is done to their client. Abusive litigation tactics do not save client(s) money and it only backlogs courts/tribunals because opposing parties will NOT tolerate abuse and will choose to fight instead. As the old saying goes, you can’t fight fire with fire and expect to win. the BEST lawyers I have opposed in an adversarial capacity have been able to bring calm, patience, and respect to litigation and any negotiations achieving justice not only for their client but also vulnerable adversaries AND the court system because it cuts delay.
Being a litigator is a lot more than going to court. It's about being a strategist, a negotiator, an advocate, and at times, the calm in the storm. It's about thriving in difficult places and helping clients overcome challenges. The role goes beyond understanding the law. It's about navigating murky waters, standing your ground and advocating fiercely for your client's position, even when things get personal or heated. It's about the grit, the tenacity, and the ability to maintain your composure in the face of adversity. It's not your everyday job. It's not for everyone. But for those with a passion for justice and resolution, it can be the ultimate career. #fearlesslitigation
