Today, I met with the Director of Public Prosecutions Stephen Parkinson, to discuss shared objectives, including disclosure reform. SFO cases are complex, crossing multiple jurisdictions and generating substantial amounts of material in the search for evidence, which then requires equally substantial disclosure exercises – often involving tens of millions of documents – in order to progress our cases through the courts. The SFO and the Crown Prosecution Service are working closely with the ongoing Jonathan Fisher KC disclosure review, which is considering potential changes to the disclosure regime. The Fisher Review is the most significant opportunity we have yet had to assess the effectiveness of disclosure procedures in the digital age, ensuring that the criminal justice system keeps pace with the evolving landscape of fraud.

DOJ's recently announced whistleblower pilot program is aimed at four areas of corporate criminal conduct, seeks to incentivize whistleblowers to report same and, at the same time, promotes corporate compliance programs. One of the areas that might prove especially fruitful: reporting fraud in, by, and against non-governmental healthcare providers. As Deputy Attorney General Argentieri observed: estimates show "billions" of dollars of fraud each year in this area. Whistleblowers need to overcome a number of challenges to recover, however: DOJ must successfully prosecute a criminal case based on the whistleblower's information and obtain a forfeiture in excess of $1 million. My colleague, Raquel Ramirez Jefferson, and I outline DOJ's program and its key takeaways below.
